Re: In VA looking for a petitioner (currently on H4)
We are all here hopefully to give advice however the end decision is with what the lawyer is telling you and what visas are available. If you do not meet any of the categories then the possibility on getting a visa allowing you to work is low
EB3 which most nurses especially newly qualified nurses come under. That category has been affected by retrogression since Oct 06 and nurses are no longer fast tracked through. If you meet EB2 or 1 requirements you are usually experienced and specialised and more than likely have some higher qualifications like masters
H1b is a specialist visa and generally newly qualified nurses do not meet requirements
H1c is only available to 14 hospitals and that is up for renewal next year with the likelihood of not being renewed.
AOS can only occur if visa allocation is current or your PD is current which at the moment for EB3 means your PD needs to be before 2002 or 2001 depending on where you was born. (PD= priority date is date your I140 was filed)
