Love Re: In VA looking for a petitioner (currently on H4)
thank you guys for your support and for your experience...

yes, I do have the SSN from a previous status, I'm legal here I do not need to go back to my country...
we do not have an GC yet, as I said my husband is in a process of getting one...
i already spoke with the best attorneys in the emigration field, specialized on foreign nurses and they told me that i need to find a sponsor...i do not have the right to work on my actual status, but i'm free to look up for a sponsor... once the sponsor apply for my change of status, my legal status is gonna change...I'll get the right to work

As the silverdragon posted earlier, the waiting line for GC is huge...and could take like 2-3 years...this is what the attorney told me, but it;s legal to look up for sponsorships, only that the process will be long and there are not so many hospitals willing to wait that amount of time ...

...so it's frustrating to pass trough so many exams, to pay so many fees and not be able to practice...

so many sleepless nighs, so many days i kept my kids indoors because I had to study... i hope I'll get my repay and I'll be free to practice my profession soon... i miss that

People who don't know what the heck they are talking about should probably refrain from replying to immigration-related threads and confusing the OP.

Ciufi clearly stated that she is on H4 currently. That does NOT mean that she has or has not got a SSN. Nor does it matter. She is looking for a petitioner, and if petitioned for a visa would obviously then be eligible for SSN and able to work. Comments like "If she doesn't have it, there's no way that she can work even if she does find a sponsor" are just rubbish. If she gets a sponsor, she'll also get a visa and SSN.

"If your husband has a green card and you were included in his petition you will be all set."
Again, it's clear that her hubby is now in H1B and in GC process, which is why she is H4.

Ciufi - info needed to give you more advice:
- What category is your husband applying for GC in? EB1, EB2, EB3?
- Do you have RN experience in another country? How much and in what area, if so?

Out of curiosity, what work permit did you have previously, and why didn't you work with it??

Once she gets a sponsor, she has to wait, please correct me if I am wrong.

"If your husband has a green card and you were included in his petition you will be all set."

If her husband applied for a green card years ago and NOW his petition came through, the poster would be able to work, once again please correct me if I am wrong. The poster said " I use to have an working permit until my husband changed his status and now he's in a process for a green card." So how do you know where this family is in the green card line. If he is close to getting a Green Card she would be able to work.

I also said many times get advice from a lawyer, which she has.

...we seem to have regulars in this international forum whose sole intent is to burst every foreign nurse's bubble and using this agenda under the guise of offering immigration advice yet not really knowing anything about how the process works. I can't believe this forum is allowing this to happen, seriously.

dear ghillbert,

thank you!

- EB3 category
- and yes, I do have RN experience in my country, 6 years I've worked on Internal Medicine Clinic (hepatology, nephrology, gastroenterology)

i never worked because I decide to study and pass all my international and local board exams...and work as RN, but times got changed, in the mean time my husband changed jobs, and with that his legal status and I've lost my working permitand became and dependent

looking forward for your reply! thank you

Hmm if he's EB3 then it may be a long time until he gets his GC (hoping the H1B doesn't time out). I would think in that case the only way you're going to get to work is if you get your own work visa - which may not be possible if you do not have specialty work experience. In this environment, tough to get sponsored in any case. It may be worth talking to a nursing agency that deals with foreign nurses (although be careful before signing any contracts). Good luck.

Just be careful with volunteering on H4 - you can only volunteer in positions that are always unpaid. eg. if there's a job that is usually paid for, but you offer to do it for free, that is not permitted.

thank you for your advices ghillbert!

...that is the reason for my first posting...are nursing agency safe for a foreign nurse like me? and if so...which one do you recommend me?

I've did legally research about the volunteering on H4 and I'm allowed to work as a volunteer only for a non-profit organization. That means that nobody within that organization gets payed for their job, every single person is an unpaid volunteer
I have a few choices, I just need my papers to be done and just take the night shift and trying to be helpful and get some more experience instead...

have a nice night and thank you again

The issue is even if you find a petitioner for a GC you can not AOS and be able to work this even includes using an agency. For a H1b you have no experience therefore do not meet the H1b requirement as that is a specialised visa
