Uscis Allows Premium Processing Option For Three Additional I-140 Categories

USCIS ALLOWS PREMIUM PROCESSING OPTION FOR THREE ADDITIONAL I-140 CATEGORIES

The USCIS has announced that starting September 25 it will begin accepting premium processing requests for the following I-140, Immigrant Petition for Alien Worker categories:

- EB-1, outstanding professors and researchers
- EB-2, members of professions with advanced degrees or exceptional ability (does not include National Interest Waiver petitions)
- EB-3, workers other than skilled workers and professionals (i.e. unskilled labor requiring less than two years of training or experience)


These additions follow an August 28th USCIS announcement opening up premium processing to EB-3 I-140 petitions filed in the EB-3 Professionals (i.e. immigrant workers with bachelor degrees who are members of the professions), and EB-3 Skilled Workers (i.e. immigrant workers capable of performing skilled labor requiring at least two years of education, training or experience) categories.

For an additional fee of $1000, Petitioners can now have their I-140 cases falling under the above-mentioned categories processed within 15-calendar days from receipt of the petition.

This will not be effective to any from the Philippines right now. You must still go thru the rest of the processing, and there is a retrogression that will be going into effect. And you will be caught behind it.

If you are in the Philippines and do not already have a US Embassy interview scheduled, you will be caught behind the retrogression.

Save your $1000.

And if you are in the US and going the AOS route, this still will not be beneficial to you at this time...........it does not give immediate approval with the I-485........only the I-140 and that is the first step in the process.
AS long as you get the I-140 and I-485 submitted before the cut-off date, then you will be able to get the EAD, just not the green cared until they are available.

This is actually not new news, went into effect in August, the 28th to be exact. Already several threads on the topic, and that it can also now be used for petitions that were previously submitted...........but again, if from one of the countries that will be involved again, it will not be helpful.

And for those from countries that are not affected, it is not needed as everything will get done much faster for you.

For Form I-140 Premium Processing Upgrade via Form I-907 Filings:


If you have already filed Form I-140, and you wish to request Premium Processing Service, file Form I-907 with the Service Center where Form I-140 is pending.

If your Form I-140 is pending with the Nebraska Service Center or the Texas Service Center, send Form I-907 to that center at the previously noted address. If your Form I-140 is pending at either the California or Vermont Service Center you may use the corresponding address listed below to file an I-907.

At the moment this service has been withheld so will have to wait and see if they review it and decide to restart it next month, although there is no guarantee that retrogression will be lifted and with the demand of certain countries I doubt it will happen
