retrogression

retrogression


There is a possibility that another retrogression will come this October. I have a petition right now. My case was approved last July 3, 2006 by the USCIS. My lawyer will send me DS230 for signing and after that it will be mailed to NVC. I'm not alone in this situation because some of my friends have the same problem. How this retrogression affect my/our case?

Getting approval on the I-140 is only the first step in the process. Not sure what is going to be done by Congress at this point. There is one bill in place that will actually do away with the cap on numbers of RNs over the next few years.

The 50,000 will be expiring shortly, and if not in the final phases of waiting for an interview with the Embassy, you will not be part of those numbers.

No one knows for sure what will happen, but the last Retrogression only lasted about six months and only affected nurses from the PIC countires. The others actually had approval very quickly, and also got their green cards quite fast.

There are still visas that are available every quarter, but it just depends on how they get used. Those are not specific for nurses. And it is based on where you were born, not where you are currently living or working. But this is true also for any of the green cards. Any cap is based on where the nurse was born. Not where they are a citizen of now, etc. All that anyone can do is proceed with getting all of their exams and documents completed and submitted, and see what happens. None of us have a crystal ball.

Retrogression of last year only covered nurses from the PIC countries.
PIC stands for Philippines, India, and China.

suzanne, how about filipinos who are in UK and who are applying in america?
are we included (we are also from the philippines,if retrogression will happen and same countries will be affected)?

not sure but if it was like last year it went on place of birth not where you are residing

yes, you are affected. the visa quotas apply to the country of birth, not the location of current work or of current citizenship.

As Anna said, it is based 100% on where you were born; it has nothing to do with where you are living or a citizen of.
