My question is as follows:
My husband's parents are already here in US as lawful permanenet residents. They have applied for my husband's GC petition back in 2005 under unmarried Son category. This was filed back in 2005. Recently we happened to notice that in the petition my husband's name is mentioned in the wrong order.
In my husband's passport it is mentioned in the following way:
Last Name: Mathews Raju
Given Name: Anup
So in the I 797 notice of action it should have been shown as
"Mathews Raju, Anup" but it is shown as "Raju, Anup M."
This could be an error from our side because at the time when we filled the form we just went by what was there in the form instead of filling it as per the passport.
Can this be corrected? Will it lead to a complete refiling of the petition leading to a new priority date?
