NVC now moving?

NVC now moving?

by HUG_ME

heard from a friend who's PD is july 04 that she recently got good news from NVC - her case is now eligible for further processing.. isn't that great? finally, nvc is moving... (despite the fact that VB cut-off is nov02)... my PD is Oct 05.. does that mean, i can hope that my papers will soon move too?

Do not make any plans with this news. What is happening to someone from the year before does not have any bearing on your petitions.

And a bigger question is why in the world with a PD date that old, are neither one of you already in the US? It means that there were problems of some type with your petition or documents from the beginning.

Hi HUG_ME, where did your friend get the message from NVC? did she/he email NVC recently?

Hi Hug_me. update us on your friend's case. Was she asked to submitted another updated DS230? I called NVC automated response last night and it says there that for the month of February they are processing applications with PD of Jan 1, 2005. Really weird isn't it? If we base on the VB, the automated response should say that for the month of Feb, they are processing applications with PD of Nov 2002(base on Feb VB). I guess they are not waiting for March to start processing cases beyond 2002. If this is true, then this is good news.

I was just wondering if your friend got correspondence already like sending another DS230 for the 3rd time to NVC.

The dates that are in the bulletin are not written in stone and never have been. The dates listed actually are only for the month that they are posted to start in. And if you have a look again at the March Visa Bulletin is states at the very top that these are the dates that they had in process when the booklet had to be ready for print and posting, and that they expected them to regress quite shortly. And the date that they were going by was around February 7th.

Do not expect dates to push forward, but to go backwards when those that filed the I-485 this summer get added to the mix, and it states that right in that Bulletin.

Until your attorney receives anything from immigration, do not assume anything. It is going to be a long process.

well, you could simply ask those with 2002 PD? why in the world, are they soooo left behind??? ours, we're just talking few years, right? ... and you are certainly correct, there have been a number of problems in processing our petition - paper works, technical delays.. etc.. etc..

i totally agree with you suzanne - never ever make any final plans - YET - but what i am saying is that NVC is MOVING>>> true enough, march VB has moved from 2002 to 2005...

let's just wait and see...

With EB3 people with a PD of 2002 are not nurses but people already in the US on other visas The only reason a nurse would have a PD of that date would be if something was wrong with their application and even then should have been resonabley resolved.

Although March VB has moved forward a huge timeframe there is nothing stopping it moving backwards again as it has done in the past and things will only start moving on the 1st March

Hi Suzanne, just want to ask if you have any idea if there are still a lot of people with PD of 2002 to 2004 from the Philippines. I know in India there are still a lot with PD of 2002 based on the posts in immigration voice. What about for the Philippines? Since most of us here are from the Philippines, we would really like to know specifically for the Philippines. There might be a possibility that there are only a few people left that is why the movement for Philippines if fast in the March VB compared to India, Mexico and China. Since you keep saying there are still a lot of people with old PD, I was just wondering from where you got this info? I've been trying to search the net for info on forums regarding AOS of people from the Philippines with old PD but have not found anything.

Plus there is also a possibility of spill-over of unused visas from EB1 and EB2 Philippines to EB3 since EB1 and EB2 have been current for the past months.

As stated in the VB:

EMPLOYMENT-BASED PREFERENCES
First: Priority Workers: 28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.
Second: Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employment-based preference level, plus any numbers not required by first preference.
Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to "Other Workers".

There are many that have been waiting for what ever reason, but the thing that many of you are failing to read is that the opening sentences in the March Bulletin state that they expect dates to retrogress again fairly quickly as soon as those that had the I-485 petitions this summer get added into the numbers.

There are also so many that have filed in the past two years from the Philippines, that even if they get to those dates, the chances of one getting a visa out of the less than 10,000 per year and including dependents, is going to be quite small.

It is not just those with the AOS, but the number that are applying in the last couple of years and the fact that the Bulletin states that they expect things to retrogress again. When you add in those with the AOS, it drives the dates back again and this is what many are failing to understand.

When you see a newbie post here bragging that they went to the US on a tourist visa and got thru on the AOS this past summer, instead of all of you congratulating them for doing something that was actually illegal, you should be upset as they will be delaying all of you from getting your visa, they have taken cuts in line in front of you.

You are focusing on dates in the past, that is not the issue with the Philippines, but the shear number of those that have applied for the green card. It far exceeds the number of visas per year. If you figure on just under 10,000 per year, and with dependents coming from that number, you are looking at only about 2500 at the most getting visas for themselves and their dependents, so not many when you look at how many are waiting.
