need some help


help,please...is there any chance when holding B2 visa while travel state can switch to H1 visa?want to stay in state while waiting for all the process..is that workable?

Sorry, but not workable. It is almost impossible to get the H1-B visa as an RN in the first place. Next date for submission of the petition is actually just a week away, so no way that any attorney will be able to get it done by then and there are strict requirements as well. That means 6 months from now and then another six months for a chance at that.

You also need to have passed the English exams, and have a Visa Screen Certificate in hand before anyone could even start the process your application. With all of the IT people from your country that are here, it is going to be impossible for you to get the H1-B visa, and even with the MSN, there is still a backlog of about five years due to the number that already hold the Master's degree from your country.

You are also under a tourist visa, there is no way that you can remain in the US at this time when your visa is over. Even with the H1-B, you cannot remain in the US while it is being processed, and the next time that they come out is in October. Well over your 180 days maximum.

The US has been under a retrogression for more than 16 months, so this is something that you should have been well aware of before you even arrived here.

And be aware that if you overstay your visa by even one day, it will be extremely difficult to get a visa in the future.
