What if 3 years have passed and your still in the Philippines and not in California but you've sent a new set of application for licensure, would CA BRN still destroy the results of your NCLEX exam??

You cannot reapply to CA until that application has expired. My suggestion as well as the other moderators here is to apply for licensure to another state that will issue a license to you without a SSN# and then you can endorse back to CA when you do get a visa for the US. CA does permit an extension of one year to the three years, if you write and ask for it. However, the extension is not something that can be done over and over again. If you are still waiting now in the immigration processing and do not already have a completed file and I mean just waiting for your interview, chances of getting a visa in the next few years are quite slim no matter what any attorney or employer is promising. There is a limit to the number of visas per year and the US has been under a retrogression for the past 14 months, so there are already a few years of visas gone when things do open up for you. There is no longer any guarantee that if one passes the NCLEX exam and finds an employer that they are guaranteed a visa in the future.

States can always change their rules as well as employers may change. Best bet is to apply using the License by Examination process for the new state and have CA send your passing results to them to make sure that you will not need to retest in the future.

Those that have just had approval on the I-140, are at the very beginning of the procedures and are now directly affected by the retrogression. The I-140 is not under the retrogression, but everything past that is.

CA is supposedly toughening their requirements shortly from what we are hearing, if asking for my recommendation, it would be to get a hard license in another state.

in order to get your license in another state and preserve your nclex results, you are going to have to go thru another state for liucensure.

your ca results have an expiration date to them.

since the questions here are having to do more with working in the us and nothing to do with working in the philippines, i am moving it to the international forum.

The decision is yours alone. Don't let anyone bother you. It's OK to listen to others opinion. In the end what really matters is if you have the strong desire to achieve it and be a successful nurse in the US. It is a head-on challenge to stay happy and positive amidst the negativity surrounding our lives.

Sorry, it is not about being negative, but being realistic.

If there are now jobs in your country, and a 5 year wait for a visa, then what is one going to do? And we are expecting the US to require the local license again as it once did when all states required the CGFNS exam, and even relavent work experience due to the shear numbers that are in school in your country now.
