Having a new Baby while Green Card is processed??


Hi!,Anybody know how does having a new baby affect our Green Card Petition? If we have a new baby and the VISA Fee Bill is already paid for the dependents, with the DS-230 already submitted? How can we include the new baby and at the same time immigrate with the baby? Does having a new baby prolong our waiting time if we want to include the baby to the petition immediately?? Thanks a lot everyone.

no problems, the baby is just added once they are born, should not have any impact on your application

thanks silverdragon, when you say just added, my wife would still be able to continue the medical exam and interview even if pregnant. If the baby is born before the issuance of VISA the baby can just be added and immigrate with us immediately. Or if the baby is born in the USA, the baby would be a citizen immediately. Is this correct?? Thanks a lot.

If your wife is pregnant at the time of embassy interview and the baby was born either in the US or your country of origin, then he/she would be added to your visa. I dont think the baby would be a US citizen if born in the US unless one of its parents has citizenship. A greencard does not give you citizenship, it just gives you permanent residency status which is different.

I think the baby if born in the US will be a citizen but would not give you any added benefit until the child is 21 years old and then if you want to live in the US they can petition for you (that is if yo do not live permanently in the US)

PhilRN2006 your understanding is correct, the issue I see is due to retrogression it is unlikely that the baby will be born in the US if you are not already there

Children of permanent resident parents who are born in the United States are US citizens. They may be entitled to dual citizenship of the US and the parent's home country, depending upon that country's laws. Children who are born abroad prior to the grant of permanent residence are the same as spouses who marry before green card approval. They may adjust status to permanent residence, if in the US, or undergo consular processing. Children born abroad after the principal's adjustment date are also entitled to the same priority date and procedure to obtain permanent resident status, if born of a marriage that occurred prior to the adjustment of status. This can be important when the derivative spouse is expecting a baby, but the baby is born after the green card case is approved.

If the baby is born in the US he/she will automatically be a US citizen.
