Dual Intent - TN and green card


Hi there,

I'm a Canadian wanting to work in the states. I'm curious as to anyone knows the legalities of applying for permanent residency (the paperwork - I know about retrogression) simultaneously with a TN. I know that "intent to immigrate" is prohibited on a tn. Is there a way to resolve this?

In theory, you make sure you have enough time left on your TN to cover you until you get the immigrant visa. As you know, you can't get one now so it would be useless to submit the paperwork.

For TN and E3 visas they are fairly lax about the "non immigrant intent" and generally accept your statement that you plan to leave the US if at any point you do not have legal status.
