Criminal Background Check

by paloyme

I see some state board require criminal background checks, is this applicable to us applicants outside the U.S.? they say it takes time to process these checks... in Arkansas,

"Criminal Background Checks
Arkansas law requires applicants for licensure by examination to submit to criminal background checks. If an
applicant has pleaded guilty or nolo contendere to or found guilty of any offense listed in ACA § 17-87-312, he/she is
not eligible for Arkansas licensure. (ACA § 17-87-312 provides the applicant an opportunity to request a waiver of
eligibility criteria related to a criminal background in certain circumstances.)
The criminal background checks shall be completed no earlier than twelve (12) months prior to being deemed eligible
to sit for the licensure examination.
Complete your application for Arkansas and FBI criminal background checks according to the enclosed instructions.
Criminal background checks may take 2 - 4 months to be processed.
DO NOT, UNDER ANY CIRCUMSTANCES, CONTACT THE ARKANSAS STATE POLICE OR THE FBI ABOUT THE
STATUS OF YOUR CRIMINAL BACKGROUND CHECKS."

Does this mean that I can't take an exam 1 year before the check is completed? I'm kinda confused.

Yes, foreign RNs must comply w/ what each State BON requires them to do. Some requires it, some don't.

As it states in their website, the processing of the fingerprint cards takes 2-4 months then and only then will the respective BON will process your application and review your credentials or any 3rd party Credential Evaluation Report.

The 12 months stated their only means that the result of the background check must be current and not more than 12 months old. If you'll be doing it for the 1st time then you have no problems because the requesting body for the background check will be addressed to the BON and they'll have it in 2-4 mos. time.

Before that you may need a background check to get your entry visa to the USA and to establish your immigration status.

Immigration Security Checks—How and Why the Process Works
Background
All applicants for a U.S. immigration benefit are subject to criminal and national security background checks to ensure they are eligible for that benefit. U.S. Citizenship and Immigration Services (USCIS), the Federal agency that oversees immigration benefits, performs checks on every applicant, regardless of ethnicity, national origin or religion.
Since 2002, USCIS has increased the number and scope of relevant background checks, processing millions of security checks without incident. However, in some cases, USCIS customers and immigrant advocates have expressed frustration over delays in processing applications, noting that individual customers have waited a year or longer for the completion of their adjudication pending the outcome of security checks. While the percentage of applicants who find their cases delayed by pending background checks is relatively small, USCIS recognizes that for those affected individuals, the additional delay and uncertainty can cause great anxiety. Although USCIS cannot guarantee the prompt resolution of every case, we can assure the public that applicants are not singled out based on race, ethnicity, religion, or national origin.

Criminal background checks are a fact of life for anyone working as a nurse in the USA. Most (if not all) states require a criminal background before being licensed. Even if they do not, virtually all facilities also require a separate check.

In addition, foreign nurses are under greater scrutiny and will have one done before being permitted to immigrate.

I know of several UK nurses that had had 3-4 sets of fingerprints/checks done before being able to work in a certain facility in Florida.

Many agencies also do credit checks.

Good Day..Could you please help me..

Im a Registered Nurse here in the Phil. I'm planning to take the NCLEX and i have to submit a fingerprint hard scan card.

I have been to the US in 2004 under my married name. I have reverted to my maiden name since the husband left in 2005. There are no divorce policies here in the Phil and i cant afford annulment fees just yet.

My question is that in the AKA part in the fingerprint card. Do i have to write my married name in that area? Does having been to the US in 2004 mean that i already have an FBI record somehow?

Pls help me.. I do not wish to compromise my application to be a US RN. My reasons for the name change is that I wanted to graduate with my maiden name on it because it was my parents who paid for my schooling..

Thank you so much.
