Colorado employer, Legal or not?


I came across this webpage foreignnurseseducation.com and became very much interested. I would like to ask if this is legal.

H-1B VISA FOR NCLEX PASSERS (Including your Spouse and Children)

YOUR SALARY AND BENEFITS:



1. FROM $63,000.00 UP TO $72,000.00 PER YEAR.


2. All hours worked over 40 hours on a given week, you will be paid 1.5 times.


Example, if you are making $20.00 per hour, you will receive $30.00 per hour for every hour worked in a given facility, after the 40TH hour in a given facility in a given week (12:00 Midnight on Sunday to 12:00 Midnight on Saturday). So this means that the 41ST hour and above will be paid at $30.00 per hour within that week.



YOUR COST WILL BE $10,500.00, PAYABLE IN ADVANCE.

1. Free housing for 90 days. You may visit www.palominoparkresort.com for more information on your housing in Colorado.

2. New car purchase within two months on a lease purchase for three years ( as soon as you start working and this will help build your credit to be able to buy a house within 12 to 24 months)

3. H-1B visa for three years and renewable for another three years.

4. All the attorney fees are paid by the employer.

5. All the USCIS processing fees are paid by the employer.

6. You will be able to arrive in the US within 60 days from processing to finish. Some of our H-1B applications have lasted for as little as 3 weeks.

7. You will receive $250.00 per month for personal expenses for two months or less, while you are waiting for your RN licensing in the US or endorsing to Colorado BON. 8. YOU WILL BE REQUIRED TO SIGN A 3 YEARS CONTRACT RENEWABLE FOR ANOTHER THREE YEARS AT YOUR DISCRETION. 9. While you are in this contract (Within the 3 years), we will apply for your Green Card if the retrogression is lifted. Then you will complete whatever period is remaining in the 3 years contract.

They are asking a lot up front. They state that the employer pays fees which is right but you shouldn't have to pay anything at all. H1b is under investigation now as most nurses do not meet requirements for H1b and are not specialists. I personally think this is a way to get you to part with money. If you loose your job and retrogression is still affecting you (more than likely) then you have to leave

They only state the employer pays everything but, we have to pay $10,500 and visa screen is not anymore needed so their reps say...

If applying for GC then you need VSC and they are still asking for 10,500 up front which is a lot. I know of people that went the H1b route and hardly had to pay as the employer did it all

Sorry, but they are giving you false information. The VSC is most definitely needed before they can submit anything for you.

And the US government requires that there is no expense incurred by the employee when they are being submitted for the H1-B. All cost must be covered by the employer. So that automatically is grounds to get things denied.

And in order to qualify for the H1-B, one is supposed to be specialist in their field. Spouses also do not get the H1-B and are unable to work in the US, they would be here as a dependent only.

Sorry, but the chances of getting the visa and being in the US in two months is just not going to happen. There are way too many red flags that I see with this as well.

I looked up the nurses on the testimonial page at only one had a Colorado nursing license. Also if you click into the page, they want you to take a second Bachelors Degree and bring you over on a student visa.

This program usually brings the nurses over on the J-1 visa, and they are required to leave the US when their visa is up. Coming here to go to school does not qualify for the H1-B visa either.

They are trying to circumvent the rules that US immigration has in place here. And with either visa, spouses and children are unable to do anything in terms of work, you would be the sole support of them. And with that pay and taxes taken out, going to be very difficult to do.

Beware of these sort of agencies. They will tell you everything is possible. But what can they do when retrogression is in effect. Before I got into this mess, I did not know what it meant by retrogression, VB and all that. I was told everything is paid for by employer but after I signed the contract they said I needed to pay for my dependents which took over $6000. They said we should complete the medical ASAP for AOS which we did but the retrogression was never lifted and it is alreay over a year and is not effective anymore. Now you cant do anythign coz you have signed a contract with them which states that you will need to pay $10500 if you break the contract. So please be extra careful when dealing with these CROOKS. They will take advantage of you and good luck you guys.

Yes, and royally screwed as well.
There are no visas available to bring you over to the US with.
And with the retrogression in place, chances of getting the H1-B visa are going to be nearly impossible.

And with the recession as bad as it is, they have to be able to prove that they cannot hire an American for the job. With unemployment here at about 10% and nurses not having work, chances are quite slim.

Bad, bad, bad, bad thing to be doing or even considering at this time. The US government is also investigating the H1-B visas at this time as well.

Nothing more than a scam at best. There are several other threads on this site by nurses that have been taken advantage of as well by them.

When something sounds too good to be true, it usually is. And in this case, most definitely.

And even more important point to it is that it states that all costs are covered by the employer, if you are having to pay any fees, this should have been a very big red flag for you. And is also grounds to immediately deny any visa for the US. H1-B visas require that the employer pay 100% of the costs and not one penny is to be paid by the employer.
