It is not a new ruling for CA, just consider it a mistake that was made. And perhaps they submitted an ITIN# that they had, this is not the kosher way of doing things and can get them into trouble down the road.
Sorry, but a Canadian immigrant does not qualify for the treaty visa, they must hold a Canadian passport and be a citizen there to get the TN Visa.
Bigger issue is what number did they put in the space that asked for the SSN#? Suspect that it was not the US SSN# and no one has caught that yet.
They still cannot work in the US, and what are they going to do if and when they get a visa for the US and have to supply the correct SSN# to the BRN? This could actually be considered fraud on their part and make them subject to losing their license.
If anything, the states are tightening their requirements and this includes CA.
