The rules are the rule.....breaking them makes for deportation. The only chance is a h1b visa which is only for advanced practice or upper management. By all means speak to a lawyer, but a lawyer does not make the laws.

Those are fake SSN's, I hope you don't want one of those. We had someone posted here a while ago who was in deep trouble, because of the fake SSN her/his parents used.

Alain

You seem to be a guy who want to the right thing. You also don't want to miss any opportunity ( which is also smart).

There are people who try to take short cuts that are not totally legal ( like citing experience that is not 100% true, for example say you have 3 years in a special area, while one volunteers in an area, that is not considered experience ).

Here is guidance from the US government - http://www.mnllp.com/GOVh1bnurse03.pdf.

Also years ago one could do an AOS ( adjustment of status ) on a tourist visa, that is no longer true.

We have read nurse brought over to find that there is no job. This is after they paid an agency thousands of dollars.

The US government is pretty black and white the purpose of a tourist visa is just that, be a tourist, not look for a job or overstay.

A reputable lawyer may charge a fee or do a free initial consult. The should tell you about retrogression, there is no way to avoid this. None.

Best of luck and let your common sense guide you and be truthful.

just trying to come up with the easiest option.

after thinking that waiting for the results of our local board exam seemed to have taken an eternity, we will be faced of another set of waiting which will seem to take more than eternity. hahaha

but we're keeping the faith and who knows retrogression will soon be lifted just when all our spirits seem to be going down.

life sometimes is Ironic, isn't it.

thanks to you guys, medsurg32rn and silverdragon for being the voices of reason.

Any advise which state issues a license for International Nurses if they pass the nclex exam besides Vermont? Planning to take the nclex soon and am looking which state I should apply.

I would say not too important to get a license issued and we are seeing many states now require a valid work/immigrant visa before they will issue a license. The main issue is not loosing NCLEX results which is what happens if the state destroys your file and at the moment I believe only Ca does this. Once in the US with a valid work/immigrant visa it is easy to get a license issued once SSN is issued

silverdragon, is this the latest process from the boards of nursing there? it seems the processing changes everytime the moon changes hahaha.
but i think they're slowly standardizing the procedure so every state has a uniform procedure with the rest.
is it easy to get a HB1 visa and how long does this usually expire? someone suggested that after passing the nclex, one can hire the services of an employment agency to task them to contact an employer for you that will petition you for issuance of an HB1 visa.

You may think it is easy to get a H1B visa, my guess who ever comes over and doesn't meet the criteria of advanced practice or upper management is going to reported to the government for fraud.

H1B expires in 3 years and can be renewed once, if you loose your job you have to return home.

I doubt if they standardise everything between states as each state will have their own requiremetns and also payment fees. Time frame differs depending on demand of applicants. But generally when you know it is getting nearer your PD you have a better idea on where you are going to be living and if registered with anther state you can get the ball rolling for the new state. You can apply for a SSN 2 weeks after you arrive in the US (your records should be on the national computer by then) and the BON/BRN can issue a license quickly once they have SSN.

Regarding H1b I can't say if it is easy or not to get one but you do need VSC in hand and employer applies either straight away if non capped or April 1st if capped. This year is the first time I have seen for nearly a decade where there are still H1b visas left usually they are all gone in hours so to me gives a good indication on how rough at the moment the US economic situation is
