approved I-140 and entering US on B2 visa


Hi,

I have an approved I-140. Can I enter US on my valid B2 visa? I will just go there for a 1 month vacation. Will I have problems / complications at port of entry since I have an approved I-140?

hi nurse_hubby... we're on the same boat, that's my concern right now. my family is planning to go on vacation in US this summer for 3 weeks and i dont want to be left behind here. could anyone share their opinion/views regarding our concern? will there be a problem in POE if we have an approved I-140? before the filing and approval of I-140, ive been spending vacation there for a number of times. TIA.

Shouldn't be a problem at all. You are going for vacation, hence the use of B1/B2 visa.

Have you already received your tourist visa?If you have I guess you must have gone through an interview at the American Embassy and they issued your visa?In that case you shouldn't have any problems travelling to the US.
But If you haven't and are going for an interview...I recommend you to bring all documents to show that you're going back home after your vacation, the officer at the Embassy would want proof that you're not going to stay there permanently.

No one can guarantee entry even if you have a tourist visa. It all depends on the officer at POE. As mentioned take proof that you are returning home at the end of your stay. ie job (letter stating you are expected back to work on x date), rent etc
