Approvals started for AOS applicants

by NYrnTX
Updated Jun 26, 2005 at 05:40 PM by NYrnTX

There are some good news indeed for AOS applicants. A user has posted in murthy.com that his/her I 485 (AOS/Green Card) got approved on Jun 23 2005 and it appears that his/her PD was April 13 2004. Most importantly (s)he was under California Service center, whom are consdiered to be the slowest among the four.

If a Schedule A AOS petition had taken only 14 months in California SC, its solid proof that Service centers had been asked to give preference on Schedule A applications since PD became current on June 6 2005. Since other EB3 visa numbers will become available by the end of this week, AOS officers will have ONLY the Schedule A Cases to adjudicate and this would surely speed up things..

If there are any other AOS applicants here, please post developments on your case.

Lets wait and see.. We've reached this far..We'll get there soon!!

Thanks for the info.

They (TSC) had issued an RFE in my case. It was expected since I didn't have my VisaScreen while filing. Since USCIS does not require VS while filing AOS, I could file it early and then I got my VS.

Do you have any idea, how long it would take service centers to process AOS? i have my EAD and currently working but i still would want to have an idea how long should i wait for my AOS. i already submitted my VS.

Thats the million dollar question which no one can answer. I am in the same boat.
Having said that, I optimistically feel it would be approved soon. The main reason is that all other EB3 categries are 'unavailable' now and even the EB2 might retrogress in the near future. In such a scenario, all adjudicating officers will have mostly the EB3-Schedule A (Nurses/PTs) applications to look at and it would really speed up things.
In my case also, I have the EAD which is set to expire on Decemebr. If nothing happens till August I will have to renew the EAD.

BTW, have you renewed your EAD anytime ? Did you get any RFE for VS or you submitted your VS 'in between' ?

Default TSC on a roll ?
After CSC, now it is TSC's turn to approve Schedule A I 485 applications in a rapid phase. murthy.com forum users have reported that two AOS applications filed on Dec 28 2004 was approved on July 5. TSC, which is considered as a slowly moving service center, approved it in aprox. 180 days.
Also, it should be noted that the approval came in the very second business day (July 4th is a holiday here due to American independence day) after the EB3 - General category became 'Unavailable'. Sems like, as we guessed before, all officers have been directed to work on Schedule A applications..

This indeed is a great news for all pending AOS applicants...

I dont think PD does matters in Schedule A case, because it is 'Current' now. Mine is Dec 2004.
If your EAD is set to expire on October, you may have to start the renewal process by the end of July. Because the official wait time for EAD renewal is 90 days and if your service center cannot renew your EAD for 'whatever reasons' in the 90 days, you can walk in to any ASC offices and get an 'interim' EAD. You can do this ONLY IF 90 days have passed after you apply for renewal. Thats the reason it is recommended to start the EAD renewal process around 100 days before the expiry. And, also note that, you cannot work even one day without a valid non expired EAD.

But the catch is, if your AOS got approved before the EAD expiry, its a waste of time and money...
