Just thought it might be fun to have a place to check what other AOS filers experiences have been, with this recent group of applications. I filed July 18, 2007 and just had my checks cashed. This part has taken 8 weeks, and I have not received my receipts yet, but think that should be happening soon. Has anyone had similar experiences? I feel lucky, though, that my application was sent to Texas. It has taken me a long time to get a chance to just apply so I feel very fortunate. But know a long wait is in store for a green card. But since my husband was able to file with me at least he will finally be able to work soon. He has not worked for over a year now.

A friend of mine applied for AOS in July 31. He already got the Receipt Notices.

Texas SC has slowed down significantly since the 2nd half of Nov. 2006. It has been averaging 5-7 mos. to give approvals or sending RFEs since then. Before Nov. 2006, TSC was averaging only 1-2 mos. for I-140s. Nebraska SC was averaging 8-12 mos. All of these were before the surge of applications in July and August. Expect both SC to take longer to process and send approvals or RFEs. The notice of receipt is just that, a notice of receipt of documents.

I would concentrate more on when you will get your EAD rather than when your I-140 and I-485 will be approved or sent an RFE because the EAD is what is needed so that you can temporarily work and you can always renew it yearly.

There are still those who filed for their I-140s and I-1485s in the mid to late 2006 that still don't have their approvals up to now (Nebraska SC) or just recently sent an RFE, so it is given that all I-140 and I-485 filers that filed on July and Aug. will be backlogged because of the surge whatever SC it may have been transfered to. Remember, there were 300,000 who filed in July and we can speculate for the sake of argument that there might be an additional 150,000 or so until Aug. 17 and there is only 140,000 visas annually. If we do the math, there would be at least a 3 year backlog that was created unless some special legislation fixes these.

No, the 300,000 was reported only for the month of July. I made a thread about it when it was published in US newspapers. Also, I-485s can still be filed up to Aug. 17 (that was the Aug. 17 deadline for) as long as the I-140 was filed before Aug 1 (this was the PD of July 31 and below deadline was for); that was the exemption.

Many law firms were unable to concurrently file the I-140 and I-485 at the same time becaus they were press for time, so many were only able to file the I-140. Just want to add that whether it is just a conservative 300k or there are actually more that has trickled in Aug., 300k still represents more than 2 years worth of visas and if they get swamped by all these applications then they might not even finish every thing in 2 years time. They are already having delays on just sending out the Notice of Receipts w/c usually are sent w/in just 2-3 weeks and we are already reading reports that majority still don't have have one plus some applicants from the last batch (particularly those under Nebraska SC) are just starting to receive their approvals and/or RFEs and some still have their I-140s pending up to now.

i don't think their consistent on issuing their receipts number. i received mine a week later compared to someone that applied the same day(july 2nd) and service center(nebraska) as i did. the good news is i received an appt date for my fingerprinting on sept 14 and then recevied my EAD on sept 17!!! i wasn't expecting it at all and thought that they made a mistake (maybe its my opt again=) anyways i want to thank GOD for His graciousness...

This is because they got swamped by 300k applications in just 1 month or so. So, you will be seeing people who filed on the same day but one having her NOR already while none yet for others. This is what usually happens on surges.

I-485 filed on 07/31/07. Pending at NSC.

Why are they not at the same service center? I think you may be lucky about e filing. I heard of a recent case where they e-filed and got their I-140 approved in 2 weeks. Amazing luck. There is no rhyme or reason to the way things are going now due to the overwhelming nature of everything. We filed on July 17 and got our fingerprinting notices and had them done Oct 4. Everyone at the facility seemed to be there for citizenship reasons. With the increase of fees this is not only effecting those filing for the green cards but also those who had delayed getting their citizenship until now. So this also adds to the workload at USCIS. I just got my EAD a few days ago. My husband is waiting for his. Hoping my hubby will get his soon since he is the one who has been waiting for work authorization for about 15 months now. Time will tell.

For some reason e-filed i-140's go to TSC. The recent update shows that they process them within 6 month. I had my fingerprints on Oct. 2nd. The waiting room was empty.
