PTO after resignation

  1. I have provided my agency with a 2 week notice of my resignation. I just learned that this agency doesn't pay out PTO and that your PTO has to have been taken 2 weeks PRIOR to your resignation (use it or lose it) The administrator put out a memo about 3 months ago telling everyone NOT to request ANY days off during the summer because she couldn't afford to have more than one nurse off at a time. So, I couldn't have used it.

    Every state is different. Make sure you check what the law is in your state. Sometimes the law requires the employer to pay a percentage of PTO.

    Yes, check with your state labor board to find out what the rules are in your state. You can't expect the employer to be honest about paying you what you are due.

    The law in my state requires employers to pay out any unused PTO. Check your state's labor laws.
