What is a disqualifying offense in NJ for a CNA candidate

Ok To start We live in New Jersey My Wife has completed a CNA course she has passed her skills and written examination . My wife has applied for Assylum as she is not from here she fled her homeland in fear of Female Genital mutilation we're still ongoing with her court case as it is a long process. She has been given a work permit by the US State Department its known as form (I-766) . Ok she went to do her finger prints and we waited for a while for a response , Finally after numerous Calls we got in touch with the people In Trenton that do the back Ground check well we contacted one of the clerks there , She stated that the case would have to be over before she could get a favorable back ground check. Now the state department has stated that she can work shes never been charged or even arrested for a Crime. Is an Assylum Case Considered disqualifyable? I want to know what a diqualifying offense is Ive searched over and over to no avail nothing spells it out specifically. We're at wits end what can we do We paid almost 2000 dollars for the course what can we do? Is there anything that can be done please help my wife is really upset over this ,and Im pulling my hair out over this please help . Thank you " Confused In New Jersey "

Have you tried contacting the New Jersey state board of nursing?

I'm pretty sure background checks are done through the Department Of Justice - in which case your wife probably doesn't exist yet. DOJ background checks can take ages, and you have to be a U.S. citizen to even have a record - to the best of my knowledge.

I admire her courage, I can't imagine............I'd ask her school (you paid money, they can answer some questions!)

Or ask the BON in your state. As a last resort, ask an immigration lawyer.

contact the department of health and senior services because in Nj the board of nursing doesnt deal with Cna's like in other states. I know, i was a cna in nj in 2002

I think that it would be of help if you contacted an Immigration Attorney (who I believe also handles Asylum cases to be able to obtain a work permit/green card). Hope everything works well.
