Invention idea, but how do I proceed with getting a prototype made?

I know I'll need a patent Atty, but it's best to have an actual device made for the patent to get approved. And once it's approved, i have no idea how to get the real thing made. Where do I begin with getting it made and manufactured. Patent Atty's do not help with that part.

Life is short, it's a risk that I'm willing to take :)

In short, it depends on what kind of device you're trying to get made. Is it metal, plastic, wood? If you know someone with access to a 3D printer, you could try that route. Or you can contact a company that can make you a plastic mold. Typically drawings are sufficient for a patent application, though, and it's very likely your attorney will have connections for manufacturing as well. The patent application process can take more than a year. You don't need the patent in order to manufacture the device. You need the patent to ensure that no one else can manufacture that design.

Since posting this, I actually did find out that there is a company in my town that will assist in designing anything on their 3D printer. I'll likely go with this since 3D printers are crazy expensive and I have no idea how to work one anyway. But before I contact this company, I guess I'll need to ensure the person designing assisting me will not steal my idea. I'm thinking I should hire an Atty to draw up a contract for no compete?

if it's anything medical, it will probably need FDA clearance, you are talking big bucks, but it you can get it patented and sell the design you are golden. just call around to machine shops and ask if they do prototyping. they will probably want the design in one of the common CAD CAM formats. otherwise check some of the maker forums. you may find someone with the tools and skills to make it or get involved in a local maker group. this explains what makers are Maker Faire |

Thank you so much! Can you estimate on how much money it'll cost to get an FDA approval? I know it's a broad question, but do you think we talking over 6 figures?

I have limited experience. My family member does work as a patent attorney and a friend of mine recently went through the process of patenting a medical device.

If you have any contacts at large hospitals- particularly those affiliated with universities or strong research ties, reach out to them. Those types of organizations may have 3D printers available for use if he request came from an employee. I wouldn't consider buying your own.

FDA approval is a whole different ball animal. Without knowing what kind of device it is, it's hard to say what kind of trials and approvals you would need, and how much that would cost.

No, they aren't located in the same state so it didn't really make sense.

Well, I guess I have my work cut out for me.

Step 1:I first need to figure out if this will be considered a Class III device that needs FDA approval. If yes, my research thus far has shown that this device will just remain a dream since FDA approval of Class III can be in the millions for approval.

Step 2: sketch out my idea and write about it in great destail. Present it to a Patent Atty and get that ball rolling.

Step 3: Get a prototype made soon after the application for the patent is sent off.

Step 4: have my prototype turned into a product.

Your search term might be 'makers space' or 'rapid prototyping'. There are some small shops that have 3-d printing at low cost, as well as engineers and manufacturers in foreign countries that don't charge much. In my home state there is a shop called kre8now which might be happy to happy to work with you wherever you might be. I hope you do this. There's nothing more fun than a new idea. Be well.
