If that is the case, how come all those E3 cat in Indian embassy..? not few..a lot...I don't think that many Australians are in India trying to go to US from India....!!

I did read about the E3 visa for Australian Citizens, but E3 could also stand for Employment (Third Preference). I'm sure a lot of you guys are familiar with it, but here's a reference I got from another website.

Q: Who is considered Employment Third Preference (E3)?

A: Skilled Workers, Professionals Holding Baccalaureate Degrees and Other Workers receive 28.6 percent of the yearly worldwide limit, plus any unused Employment First and Second Preference visas. All Third Preference applicants require an approved I-140 petition filed by the prospective employer. All such workers require a labor certification, or Schedule A designation, or evidence that they qualify for one of the shortage occupations in the Labor Market Information Pilot Program. There are three subgroups within this category:
Skilled workers are persons capable of performing a job requiring at least two years' training or experience
Professionals with a baccalaureate degree are members of a profession with at least a university bachelor's degree; and
Other workers are those persons capable of filling positions requiring less than two years' training or experience

What you are describing above is the EB-3, it is not the E3 that is specific for Australians. They are two very different visas.

Nurses that are being petitioned are under the EB-3 category unless they are from Aussie and are just using the E-3 as a temporary visa.

I got the reference from this website, which probably somehow caused the confusion.

Yes ..you are correct..its looks E3 and EB3 are same..
Anyway, I am sure, There is not many Australians in India waiting for a interview date in Chennai embassy.(more than 50 in a month..? no way..)

Nurses are under the EB-3 category which is the third preference.

The specific E3 category is for Aussies only, and is a temporary visa as well. That is why there are mix-ups about this. The E-3 for Ausies does not have anything to do with the green card; it is only a treaty visa, similar to what the Mexican and Canadian nurses use, except that the spouse can work with the Aussie visa, but not with the TN Visa.

What you are looking at under the green card visa applications is actually the EB-3.

They are listing it as the third preference, and that is actually the EB-3. You can see it called the E-3 on some things, but it is for the green card, and is actually the EB-3.

The actual visa called the E-3 is the termorary treaty visa only for those that hold the Australian passport.

Third preference in the immigrant processing is actually the EB-3. If you were in Australia, you would see the actual difference as they have both the temorary treaty visa, as well as the immigrant visa processing.

That is why there are so many E3s in India, they are third preference under the immigrant visa status. That is different from the E-3 under the Aussie visas.

The point is that there are many from India that are in other categories as well as nursing that are in the process of getting the immigrant visa. There is no Schedule A, so all RNs are included in with this large number. The retrogression is still not over. Most are under the third preference, including nurses that are not being fast-tracked currently.

I am originally from the Philippines but I had E3 Category put in my Visa Application. It was accepted and processed. So, therefore all I can say is E3 has been used interchangeably with EB3 (in some embassies maybe, no idea on this one)

But there also exists an E3 Category(as explained by Suzanne) that is only applicable to Aussies.

If you say you had E3 applicants in India, they have been in actual fact applying for EB3.

Hope this makes sense
