Hi Lawrence,
My case filed on May 30 ,2006 but still waiting for approval in texas center. Any idea about this case?

hello, suzanne.
my PD was november 24,2005, approval, april 16,2006, and got a notification from nvc that case completed last october,2006.then, retrogression came.
now that july visa bulletin is current, nvc is asking for a re-submission of ds230. my question is this... why do they need another set od ds230 when it was already approved last year of october? i am afraid it will never end as after submitting a new one, another retrogression might set in again... i am confused of the process. please enlighten me.
also, after i have submitted my new ds230, what do you think is my chance for an interview?
appreciate very much of your efforts and time in clarifying these matters.

if you filed in may 06 and still waiting then there is definately something wrong with your file. I filed in aug 06 and had approval in 11 days although now it is taking a lot longer. What has your lawyer said about this?

quite a few are being asked to resubmit DS230 I would do it without delay. You have a chance like everyone else on getting an interview if there are visas available but if your file is not up to date it will delay you

It is what as it is indicated. Pending. You may want to ask the lawyer handling your case why this is so. It seems you are being left behind. If you will read through this thread there are nurses whose cases were filed much later than yours and they were all either reviewed or approved already.

lawrence, how would y know that the case was reviewed? i checked my online status, and i see some updates but no change in status. it is still pending,. when it is reviewed do u see updated or should it say processed..oh i got my work permit extension in a month,, so it does not take long to extend it..

hi, lawrence,
thanks for that piece of advise. 
i have acyually sent my updated form but i'm not sure whether my lawyer will pass it to nvc immediately or he might wait for all of my batchmate to submit and pass altogether to nvc... my lawyer is based in america and i hope he is aware of the time element involved...
anyway, waiting is not so bad, after all. i realized i'm a very patient person when it comes to moments like this one.

If the status says, pending... It has not been fully reviewed. A fully reviewed case should have an updated status as well. It could be an outright notice of approval (NOA) or USCIS will send a Request for Further Evidence (RFE) if something is missing then finally a notice of denial (NOD) if they were not satisfied.

If you are paying for this lawyer out of your own pocket then he must do it as soon as it is possible to do so. However, if he is being paid by the agency then usually they file things in batches.

You are under a different case as you are under the AOS/EAD. The above are under the Consular Processing.
With the AOS, you can see anything posted. As long as your petitions were submitted before the cut-off last August, you are still being processed. Where we usually see the hold-ups is with the English exams, but you do not need to worry about that.
