Thanks for your help anyway, it always has been precious and so right.
Those unused visas were used last May and June and did not make a dent in the number that are waiting. And they only went to those with completed files, and that is the point that I keep bringing up over and over again. Does not matter if a date is current, but if the file is not, then it really does not matter.

You probably encountered this type of question already. My concern is I got my I-485 card last year 2007 month of July and my country of birth was Philippines. NSC replied in September and they said the processing date for my wife's I-824 was started in Sept 12, 2007.

With the retrogression in place right now, suspect that it will be the routine two years that applies even in the best of situations. Even though this does not apply directly to her, the fact that there are so many also waiting ahead of her, and even without the retrogression, the time has been two years if they were not submitted at the same time as you.

On Monday, I will call my lawyer to check with him whether the AOS route is open to me. In your previous message, you wrote that AOS is not open to me as USCIS is not accepting I-485 at the moment. I visited the web-site and was not able to find information related to that claim. I found this
"As a result, beginning today, U.S. Citizenship and Immigration Services (USCIS) is rejecting applications to adjust status (Form I-485) filed by aliens whose priority dates are not current under the revised July Visa Bulletin".
Is this what you reference to ? If it's the case It is clear therefore that my lawyer is strangely not aware of that critical information.
Just a quick question, do you think I should report to the Hospital the lack of professionalism of the attorney. I guess they might want to know that the Attorney that they have been paying for 3 years for my case is not efficient.

That is it exactly, there is no way to file for AOS since they are not accepting the I-485.

With a 2005 PD, the National Visa center should be processing your case for consular processing or have sent a letter to your attorney already for any updates for expired police clearances, to update the DS-230 forms, etc...
The farthest one that have been reported is with a PD of Nov. 2006 and I would not be surprised if they've been processing up to a PD of Dec. 2006.
It's very odd that AOS would be entertained at all when CP is moving very fast now.
Exactly, but do not think that she has a completed file at this time with approval of the first DS-230 and that is where more problems for her come up. And this is the reason for the swift movement of PD dates, due to non-completed files.

hi Suzanne. if California is not ideal for my initial application, what do you recommend as the best, fastest, most convenient, less complicated state board for us to apply to? It's hard for me to browse each of the state board's website of course. You know, the state that does not require CGFNS and takes less time. Which state board do you suggest? Ofcourse, after getting a license in that state, i will still apply in California by endorsement.
Next question,I understand all states will require a social security number? how do i acquire that when i haven't been in the US?

Suzanne may not be able to answer you as soon as you want, so will chime in a bit.
It is generally not recommended because it needs a US SSN to be given licensure, it also now requires local license, it takes 4-6 mos. for processing and sometimes longer depending on the workload and they send results only about 3-6 weeks after the exam. The letter they send that you passed NCLEX also contains a condition that you need to furnish a US SSN within 3 years or your file with them expires unless they grant you a one year extension upon a formal request.
Majority cannot handle the long wait and go crazy. If you think any of the disadvantages is a non-issue to you or you find more pros than cons then you can still go ahead.
VT BON is also only one of the Boards that also still evaluates transcripts on their own and has no US SSN requirement. It does have a local licence req't as well. Most Boards will be asking for local licenses sooner or later anyway. CA BRN is in fact the latest Board to ask for the local license as a req't unless there is a valid reason of not being able to take it.
A US SSN can only be acquired when you are already in the US and able to present a legal status to work legally in the US, in short you have to go through the immigration process first before you can apply for it.
If you want more info. you need to find time to do more reading in the forums and checking out the websites of some of the Boards. You might find it hard to get a straight answer next time around if they know your question has been asked and answered countless times before. Recent changes from some Boards such as from NM and AZ has also been posted in the forums already as well.

Thank you once again for your reply. As always..
I was not petitioned together with my mom since it was my mom at first who got her immigrant status through a petition by my sister who was already a citizen. Then after my mom got her immigrant status, she petitioned me under I-130 (Unmarried child under 21 of an immigrant). I believe this was the advice we got from an immigration advocate center that we consulted at that time.
I was just wondering as to how can I monitor my case aside from the online profile account I made on the USCIS website? Where can I view the family-based category update? Is it shown on the Visa Bulletin?

Hi, I would just like to clarify something...I got my eligibility from the state of Vermont on September 21, 2007. I was told that I have to register with Pearsonvue then submit the candidate number back to Vermont, then the state of vermont would inform Pearsonvue that I am eligilble then I would get my ATT. After I receive my ATT, I only have 90days to take the exam.
My question is this, will my eligibility expire?? If it will expire, when? 1 year? 2 years?? 3 years? Do i have to take the exam before September 21, 2008?? Or can I register anytime I want and the only expiry I have to worry about is only when I receive my ATT already?
Also, I've read at some of the forums that only 5 states require the CGFNS exam, what are those states??
Please help!!!

It can be viewed on the same Visa Bulletin, there is just a separate section for it. You just want to look for the Family-Based Petition section.
What was done for petitioning you that way was just fine, I did not know how your mother was petitioned in the first place; whether from a job or something else.

The letter that you receive from VT will tell you when it expires as far as having the eligibility remain current. Usually it has been a year, but things do change. The exam must be completed before the eligibility expires and within 90 days of getting the ATT. Or everything is cancelled out and you start all over again.
There is no reason to list the states here again, you just need to take the time to do some reading.
