And are you aware that as a foreign trained nurse, you are going to find it quite difficult to get an employer in NY? Actually average wait time for NY is about 8 months or so before you will be able to test, and that still will not get you a license where you want as you will need to meet their requirements as well for endorsement.
If you are not going to be working in NY, then there was no reason to go thru there for licensure. Actually, there are many states that do not require the language exam for licensure as they know that you are going to need to pass it to get the visa. No way around that at all, but you may have spent alot of money and it will not benefit you at all.

i am already a greencard holder in US . i don't have to go through visa process. do you i still need a score for toefl? could you tell me what other states don't require the english score?so, i can apply for if it is more earlier than NY. i appreciate your help. it will be so helpfull.

He said to just wait and not even try to have a working visa while waiting as my Family Sponsored Immigrant Visa will be jeopardized. Please enlighten me more on this. I would greatly appreciate it.

I just have some clarifications with the replies you have made on this original post I made. I guess there was some confusion. I just want to clear that I have an I-130 petition not an I-140.  But that's ok, I completely understand. With all the questions around here it is not easy to set things clearly.

I presume that nothing really changed with the status of my case. Am I right on this one? Since up until the present (April 2008) I haven't got a word from them yet through the mail. Yes, I'm really depressed and sad that I cannot go there yet. Although I have a tourist visa and from time to time I would visit my family there. It's just sad for me that it took me this long.

Licensure and immigration are two very different things, and if the state requires the English, then that is what you are going to need to do if you wish to work there.
Massachusetts requires the English exams even if you hold a US passport already, but trained out of the US.
You need excellent English skills to be able to work in the US; you need to be able to chart properly and provide communication skills both with your patients as well as other staff members. I would focus on passing of the English exams, so that you can work where you wish to work. If they are required, then you cannot endorse without having them passed as well. And employers want to see excellent communication skills, you need to write a cover letter to a resume, etc. And language skills have kept people from getting jobs.

Family sponsored petitions have a different schedule, they are not under the ones for the employer-driven petitions.
So unless you were petitioned years ago, there is no way that you have approval on it at this time as far as being in-line to get the green card.

When was your petition submitted for the family based petitioning? That would be my first question and who is petitioning you would be the next?
Cannot give you a reasonable idea without knowing that.

is it okay if i sent my application form to the California board of Registered nursing earlier than my Fingerprint card(hard card form), i always email the brn of california to confirm my status but i didn't receive any response. i am waiting for my eligibility since november 2007,what should i do? thanks

One quick question; in immigration terminology, what does the phrase "immigrant worker with approved petition" mean?
appoved i-140/approved DS-230/ case at embassy????
