Once you have the immigrant visa, nobody can take it away from even you failed the NCLEX several times. The only thing that the US government can strip you of that is when you have committed criminal acts, I read that somewhere.....please don't ask me the source or website address...
But the important thing is, one must pass the NCLEX otherwise you will be terminated by the your employer, this is a case to case basis. I have seen employment contracts that stipulated that the nurse will have to pass the NCLEX within a year after arrival or face termination.
Also, if you failed the NCLEX then you will be working as a nursing aide and you will have difficulties supporting your family because of your low wages.
