I am sorry to hear that but let me ask another question before commenting, what if, god forbids!, you did not pass the NCLEX, what will happen to your immigrant visa? I am really sorry If I sound intrusive.

If you have an immigrant visa, then you will still have it as long as you have met the requirements of the green card by passing CGFNS and the English exams.

If you do not pass the exam, then you retake it 45 days later............it is just helping the employer for having to pay extra expenses until you can taks the exam. But you should not need any help with passing.

yes the visa is in the passport. they want that together with the other documents given by the US embassy,the one you have to present to the immigration officer at the port of entry.

I already asked the immigration lawyer that... and he said that in the event that I do not pass the NCLEX.... i will have to retake the NCLEX ASAP... now in the case that its not possible... i will have to be deployed before the expiration of the visa.

Once you have the immigrant visa, nobody can take it away from even you failed the NCLEX several times. The only thing that the US government can strip you of that is when you have committed criminal acts, I read that somewhere.....please don't ask me the source or website address...

But the important thing is, one must pass the NCLEX otherwise you will be terminated by the your employer, this is a case to case basis. I have seen employment contracts that stipulated that the nurse will have to pass the NCLEX within a year after arrival or face termination.

Also, if you failed the NCLEX then you will be working as a nursing aide and you will have difficulties supporting your family because of your low wages.

These are very unfortunate situation and unfortunately a lot of nurses here in the Philippnes are tied up, or should I say, LOCKED UP with these kind of agencies. Have several acquaintances whose immigration application are in jeopardy because other agencies filed a case against his agency for allegedly pirating nurse applicants. I hope this will not become rampant because at the end of the day, the victim will be the poor nurses who are just after "the good life".

I know this is the nth time already, be wary of the agencies who entice you with good to be true promises and quick fixes and in return nurse applicants should be "loyal" and truthful and avoid possible illegal practice.
