A lawyer will know how to do this. If a lawsuit has been filed, the court will issue a subpoena for documents at the request of the plaintiff, which these would be, and the defendants must comply with the order. The OP, herself might have a copy of the final draft of the papers.

as i was reading the response before yours, it struck me, that if i were to ever go back to school i would be keeping copies of everything!!!!

I keep everything because I usually do it on the computer over a few days/weeks. Usually, if done in Word you can go back and retrieve it. I truly hate that many programs nix you if you fail something 2x's. My school is the same way. I've seen many students go on to other schools and succeed. I've found with most of these students that they are so smart (book) or knowledgeable in the clinical setting that my confidence gets rattled. I understand standards, but it's still so hard to witness good students having to find another school to make it. I wish you the best of luck.

I hope this doesn't sound unduly harsh, but if your previous posts are any indication I suspect the problem wasn't your instructor. Perhaps you should consider taking some writing and grammar classes before continuing on. Don't give up, if you really want it you can get there.

I hate to say it, but it happens more than we know. It's just like anywhere you work. There is always somebody who has issues, usually from home, and their feelings and opinions reflect on somebody they think they can push around. I worked as a Paramedic for almost 15 years before nursing school. I worked with different services and I saw more messed up people who had problems at home and they used the "Paragod Syndrome" to chew up innocent new people and spit them out. I couldn't tell you how many Paramedics I saw like that. They were instructors too and that is one reason I got out of it. I saw these Paramedics say things to patients and co workers that you wouldn't believe. At least in nursing, the environment is much more controlled. I actually have an english instructor that I have had problems with and I have had to literally kiss her fanny to keep things going smooth. I hate myself for having to do that but she just does not like me and I don't know why. I'm on pins and needles to get through the next two weeks to finish my LPN. My nursing grades are good but I'm on the fence with my English. I don't think these courses should be allowed in with the nursing courses but that is my school. She gave me an "F" on my first paper and I have had four other English classes that have all been "A"s. I even have teachers in my family that said she was wrong about the grade and her comments on why I got an "F". They think I should go for her job but I'm just going to turn it over to my higher power and let him handle her. I also had a difficult clinical instructor in last semester that rode my tail constantly. She even put me down in front of patients and their families. One patient's family member in the room was an RN. She said that if one of her nursing instructors talked to her like that, she would go over her head. I just gave her a bad evaluation for the course instructor and told them what she did. She is still there. I found out that she had been up all night, grading papers, careplans, is handling two clinical days per week, has three small children, her husband is away on business and she is working on her Master's on line. So there you go. Always some issue that doesn't have anything to do with us. We are just innocent people who appear to be something they can take their anger and frustrations out on. I saw her last week and she gave me a hug and was so happy to see me. I guess she had sleep, the kids were with a babysitter and her husband was home and she had her homework for her Masters caught up. Who knows. I actually was feeling guilty for leaving a bad evaluation after I saw her last week and she was so happy to see me, but I soon dismissed that feeling. She was wrong and unprofessional to chew me and act like that in front of a patient and the family. She could have taken me aside and been more professional. So I was right to give her that evaluation. It is important to act professional when you are teaching new people. Leaves a bad impression and makes us think it is okay to do that and it is not. I'll say a prayer that you will find your answers in this situation. If you are meant to be a nurse and it is in your heart, you will be no matter what obsticles you run into. Remember that always. To my ear, this did sound unduly harsh. Just because someone may not use perfect grammar or writing on an online forum does not indicate that they turn in academic papers of the same caliber. Are we sure that the reason why the OP received a low grade on her paper was because of her grammar or writing skills? Perhaps it was the content, or as the OP suggested, a personality conflict? As much as we'd like to believe that nursing instructors are above this sort of behavior, some of them are not, sadly.

I had a meeting with an instructor today, and asked him if he would ever agree to be an "objective party" and read a paper for a student from another school. He said "not unless I knew why I was being asked."
I don't know that an instructor from another school would want to put themselves into the middle of a legal situation.

Actually it wasnt unduly harsh but actually rather rude!
I dont think you can judge someones work ethic or what they do for school in the same light as what they type in posts on a board.

I agree with other posters who suggested you exhaust all avenues in the system before hiring a lawyer. can you get in touch with other clinical instructors? (you are so close to graduating - you must have other instructors who felt you were good enough to pass and continue on) I also would try to find an unbiased instructor to read your paper. I'm sure some instructors would feel uncomfortable, but I'm also sure you could find many who would be ok with it. what about nurses you worked with at the hospital? would any of them write you a "letter of reference"? once these have been exhausted then go through the legalities, but hopefully you won't have to get that far! I wish you all the best!

I did not find it rude at all. It was brutally honest.
The original poster's posts lack clarity of thought and proper grammar among other things. That is especially important when you state you have been dismissed for similar reasons. Why should we think her work is any different.
People are so quick to threaten lawsuits. Maybe a little introspection is what is needed.
