Questions? - Can anyone help me with my defense memorandum PLEASE?

Hi everyone. I am not at all pleased with the program I chose for my LNC course. They supposedly have mentors that you can email with any questions. The first time I had a question, it took them about 24 hours to repond, and their response was "watch the DVD". I already watched the DVD! I needed more clarification. This time it has been 3 days and no response from my second email. SO, I hope someone can help me!

I am supposed to write a Plaintiff memo (the patient) and a defense memo (the nurse, doc, etc.)They say to use 4 parts. In a plaintiffs memo I am supposed to include a factual background, a chronology of events, issues of liability, an analysis and damages in the memo. What 4 of these do you think they want? Am I trying to shift the liability to someone else? And when you write a defense chronology, are you trying to word it favorably for the defendant? Because in my plaintiff memo I made the defendant sound bad just by the way I worded it. The only thing I know is that they don't want you to include the breaches in the defense memo. Any suggestions? Thanks!

Hello Amber,

I've never been approached to write a "defense memo", so to speak, so I cannot address the terminology I do not think.

In what context have they asked you to do this? Pre-discovery? Discovery? Deposition? Trial?

What I surmise this to be is to write a report memo to include:
  • Duty
  • Breach of Duty
  • Causation
  • Damages
Or:
  • Central Issues
  • Facts of the Case
  • Factual Chronology
  • Four Elements of the Case
One thing you could do is contact them and ask, "What format do you require? - Do you have a sample of the format that you require/prefer for the defense memo?". That way, they can give you an idea of what they want and what is expected of you.

As for "wording" the document, you stick to facts as they relate to the case. Your goal is to educate the reader and/or try to persuade them into agreeing with the written opinion. Yes, the defense is trying to shift blame.

Are you near a law school? Law libraries have "form books" with examples of differant examples of every and all legal forms, memorandums, etc. You could also try a community college that has a paralegal pragram because they also have law books and forms books.

When I was in the Legal Nurse Certificate program at Spokane Community College, we bough a book that was written by a local law office paralegal. It was also a forms book that had examples of every all the differant types of motion, memorandums, you name it. They have an online book store, and if you contact them may be you can buy it on line. I bought it several years ago, and it was only $6.00. Thats it. PM me if you need more information. I could probably come up with something. I know that I have a Plaintiff memorandum. Let me know.
