Hard to believe this thread is still so active. No one can touch you or invade your personal space without your consent. The patient signed consent for a specific surgical procedure. The doctor's competence or lack thereof has no bearing. You cannot treat patients like your personal canvas. If he wants to express himself with art he needs to do so via an appropriate outlet. If he wants to make his patients happy he can give them a discount on his bill.

A temporary tattoo? You mean... like... one of those stickers we get in a box o' cereal?

I haven't read all the responses here, so this may have already been said, but....

I don't think it's a matter of "dirty minds". Just imagine how this woman could have felt. Even if this was done with the purest of intentions, and putting aside your own feelings if this is something that would not have personally bothered you, imagine how THIS woman could have felt. To be under anesthesia is a very anxious and vulnerable time for most people, and couple that with just about any surgery that requires you to be in a state of undress. Even if the "tattoo" wasn't "below" the pantyline, if was remotely close to any "private" areas, imagine the fear that woman could have felt. What if she was a raped/molested/abused? Imagine the fear that this act could have provoked or made worse by having someone do something to your body without your consent or knowlege. I think I might have wondered what else happened while I was unconscious.

Even if his intentions were good, even if most pts enjoy this "artwork", he had to of known that not everyone would take kindly to this.

So I guess it's time for my : If I were the patient, I'd probably be stunned to find the rose, but after determining that my husband didn't do the weird thing himself, would want to know why the MD did it. And after finding out that it was a "pick me up" he does for all his patients, I guess I'd clue him in that it really is unprofessional and shouldn't have been done without my permission. I'd want a full-fledged apology, but that's about it. I suppose if I were incensed enough about it, I'd let the Board know they have someone in their profession running around doing this, and they could expect someone to sue at some point--but that lawsuit would not be coming from me.

My thougths are that I'd have to put it into perspective: I had a successful surgery. The tattoo was a poor judgment call, seems a little immature actually, but it didn't hurt me. Since this fella puts it in ALL his patients, it's not like the rest of the OR team was unaware what was going on; I somehow can't see a giggle-fest over him putting in on this time. I don't care if the hosptial states there were "no witnesses" this time; there are obviously lots of witnesses to this having happened before. And I believe someone saw it this time, too.

At any rate, while we're not supposed to tell people how to feel in a given situation, we can recognize if someone is overreacting. Plenty of people will disagree with me on this, but I think it's overreacting to sue the guy for this. Yell at him, chew him out, tell him you think it's a really stupid thing to do, demand that he take some cash off the bill if you want, whatever....but go to court asking for a judgment? A bit much, IMO.

I completely agree. suing is a bit much, but someone definately needed to let this guy know that this is not ok.

Where was the circulating nurse? Her job is PATIENT ADVOCACY and making sure everything done is in the patient's best interest... Although I do not find the doc's actions offensive, I am just wondering what was really going on here. I have been in many surgeries and NEVER at ANY TIME have I seen a surgeon alone with a patient...
