Good question, I have heard that owners of LTC facilities have sold the facilities rather than pay the fines from state or to get rid of a union.Some of these places go through as much as three owners in a year.

At will employment is at will employment. If that is the case here, the owner has every right to rid his establishment of employees that do not meet his criteria. Our facility was bought out by a big company and all of us had to apply for our own positions. I am certain that the job applications were thoroughly screened to pick out the persons who would be laid off when they did downsize 3 months after taking over. Like most job applications, their application had the customary at will employment disclaimer at the end.

If it was not in the contract that the new owner was required to keep the union in place, then they legally do not have to. The contract was with the previous owner and that corporation. The new owner is a new entity and they can do as they please.

Agree with Suzanne4. If you are working in a unionized facility see if your contract has a successor and assigns clause written in to it. If it doesn't make sure you have the union bring it up at the next contract negotiations.

When I read so many stories questioning why there's this sense of unease among the middle class, I immediately think of stories like this.

often a facility can 'change ownership' with the same people owning stock in the new corp
they can also, if problem is with the state, fire don and a couple of nurses and take no responsibility in the lack of supplies given or the high ratio of nurses/cnas to patient
