Judge orders fired nurse to repay company

Christinita Delalamon is not like the other foreign-born nurses who were sued by Global Nursing Solutions: She fought back.

Ms. Delalamon, 46, of York, was fired in 2007 after she refused to sign an extension of her contract. After the company fired her, it sued her for the $15,000 it paid for her to come to the United States.

While seven other nurses settled breach of contract suits, Ms. Delalamon took the issue to court.
She won the first round before a panel of arbitrators, but the company appealed the decision to Common Pleas Court.

On Tuesday, after a nonjury trial last week, Allegheny County Judge Eugene F. Scanlon Jr. reversed the arbitrators' decision by giving the company some damages.

I have mixed feelings about this.

She signed a contract for 2 yrs of service but then was fired by the hospital after only 3 months.

Why was she fired? Was she unsafe? If so, then she should have been deported because we have enough unsafe practitioners that were born and raised in this country, we don't need to import them. If she wasn't unsafe, then what was the reason for termination?

Considering that the company supported her for several months while trying to get her other assignments, I believe that it was only fair that they ask her to sign an extension since she did not fulfill the contract and did not work for several months. They did spend a fortune getting her here, regardless if there are other issues going on with the company.

I do think that this was used to send a message to foreign nurses. You don't see this type of thing happening to native US citizens. It's a shame she found out the hard way. On a personal level I feel sorry for this nurse. On a professional level, I am adverse to the continued mass influx of foreign nurses, many of whom are not up to US practice standards, being recruited by shady companies that continue to erode our ability to fix the healthcare problems and obtain leverage against these big business corporations.

Me too. I always say, I don't think there is truly a shortage of nurses, only a shortage of nurses who are willing to work under certain, unfortunately common conditions. Importing nurses is NOT fixing those conditions. Instead, it is lowering the standards and increasing the problem, while also possibly lowering salaries for nurses in general. Having said that, I do know some foreign BORN nurses, who are now US citizens who are awesome nurses.

She wasn't even a nurse, she was a doctor, maybe that's why she got fired.

Showing again that MD's and RN's are not interchangeable; nor are nurses "assistant doctors". Maybe she got fired because she did NOT have the education or clinical experience to BE a NURSE!!

OK, heres my take on this. The whole thing smells fishy. In one part it states she refused to extend her contract. Since when do you have to extend a contact? I thought that extending a contract is an option and that you simply have to fulfill the primary agreement. If the original contract did not work out then simply follow the provisions made for that case, if there are none, oh well to bad for the company.

Then it says she is a doctor but worked as a nurse. What kind of contradiction is that. What kind of license does she hold?

Hey Toto I think we have left Kansas, anyone else see some problems here?

By the way, I fully agree that we do not need to import Nurses and so drain their home countries of an important resource, but we need to make nursing in the US something people here can actually do in a safe manner and feel good about what they did.

You would not call the plumper to come to your house to install some new electrical wiring either would you?
