Supreme Court rejects death penalty for raping children

The Supreme Court on Wednesday outlawed executions of people convicted of raping a child. In a 5-4 vote, the court said the Louisiana law allowing the death penalty to be imposed in such cases violates the Constitution's ban on cruel and unusual punishment.

this was a horrible case but i have to agree with the ruling, because the argument was put forth that if they raped a child they would then go ahead and kill them to leave no witnesses
life in angola is no picnic,

The court was reaffirming settled law. The death penalty is unconstitutional for rape.

Lengthy incarceration and mandatory treatment is constituitonal....:>>

I am not for the death penalty.
I do think that it would be good to pass a law requiring life in prison with NO parole for one convicted of molesting a pre adolescent child.

OMG Death, by tortuous means is too good for such scum!
Anyone who takes a childs innocence.., who hurts their pure souls....should be tortured to death, no question..period!

Good thing the justice system is about reform and not revenge.

BTW - They are scum... the problem is that it becomes a slippery slope. More and more crimes become eligible for the death penalty and before you know it. Protesters get shot on site.

Stanley, I have trouble understanding the difference when it comes to sheer scum of the earth that hurt babies and children. I respect your points, but how do you begin to reform a mind that can take away the life of an innocent child. I honestly don't feel that reform and forgiveness in anyway comes into crimes so heinous...torture as they have tortured is the only true punishment, As a mother, if anyone hurt my children, let me be first in line and hang the consequence. Plain and simple, not just revenge..JUSTICE..for any evil beings who damage our babies!

As a father of a child that has died I understand. However, if you were to mete out the 'justice' it would only amount to revenge. People that can't be reformed are given full life sentences. However you can't decide which crime is heinous enough to immediately warrant death. As much as I despise these people too, justice has to be just. The child still has his life so the criminal must keep theirs.

I understand that if it was my child then I would want revenge. It would be revenge too. That is why a jury and judge rule, not victims.

Now if they kill a child, kill em. If they just rape a child well... If damaging a person's life emotionally and psychologically was punishable by death then when do we start lining up abusive parents and significant others?

We are talking about rape here... Murder warrants death.
