Angry Getting the run around when trying to get paycheck from nursing agency

I am a CNA and I had worked for a nursing agency for 2 weeks. I got my first paycheck right on schedual but thought it was funny that my paycheck came in the form of a personal check. After my second week of work, I never recieved a paycheck nor have been schedualed to work. I know of atleast 2 other people who worked through the same agency and had the same problems. I was supposed to recieve my paycheck in the middle of August and here it is October. I have called her many times and she has stopped answering the phone. I have tried the BBB but they say all they can do is try but if no one answers the phone then there is nothing they can do. I don't know what else to do. I could get an attorney but I can't afford to pay around $1,000 for attorney fees when my check won't even be that much. Any advice?

Call the licensing organization for the agency. Then call your closest television station with a consumer reporter and see if they will pursue it. ALso, contact the place that you worked when sent by this agency, and ask if there are any known problems with them, are they still in contact, etc. If they paid them for your work, I am sure they would be interested to hear that you didn't get your cut.

Next, camp out in front of their door.

I would agree with MSCHRISCO in that you should report the matter to the State Department of Labor. Depending upon where you live, you also might wish to consider filing suit in Small Claims Court which does not require an attorney (You do all the paper work). If the Agency is in a small community you might wish to file a complaint with the Police Department as it appears the Agency may be working a scam. Sometimes an inquiry from the Police is all it takes to obtain prompt payment. If you live in an area that has a Justice of the Peace Court, they will often undertake action on behalf of the victim or plaintiff. Good luck.
