So I live in Georgia..been through years of school, and am about to receive my nursing license! However, about 7 years ago I made a HUGE mistake (shoplifted) and my family paid thousands to get this expunged. I am so SCARED that this will show up on my background check as they are requiring fingerprints now..<br />
Should I declare this? What type of penalty will I receive for answering yes to arrests? How long will it take them to review my file? How long will I have to wait to take the Boards? Will it say on my license that I have had a misdemeanor? <br />
If it is expunged, is it really erased from your record? Ive ran several background checks on myself and nothing has ever come up...However, fingerprinting is a new concept and I have never had to do this before..<br />
What happens if they find it after you fill out the application? Will the BON refuse your expungement papers after you have answered 'no' to the question about arrest?<br />
Anyone ever been in a situation like this? Thanks!</div>

However two weeks before actually sitting for my nclex i got in a huge fight with my daughters father and he lied and pressed charges on me. Criminal mischief in the 3rd degree which happens to be a felony in NY state. I quickly called my lawyer and he is working to get the charges dropped i was no where near the scene of the crime or in the same city so getting rid of it is not an issue however are they gonna still give me my license or prolly not? on the positive side i passed my nclex :yeah:but im just scared they wont give me my license .</div>

			<content:encoded><![CDATA[<div>I am looking for some insight from those who have personally been through the Georgia LPN licensing process from anyone who has had an old conviction (15+ years).  Mine in particular is a misdemeanor.<br />
<br />
I have passed my NCLEX and I am now waiting for the licensing process to be completed.  I understand that the process takes longer for folks like me however, the LPN Board office is very vague in giving an indication of the time required to process this situation.   I am not really concerned about being denied a license, however I have secured employment and can't start until my license is issued.  The people at the board are very nice but very vague.<br />
<br />
If you've personally been through this process, can you give me some guidance as to how long it took to process your license?  Weeks? Months? Years?<br />
<br />
Again, for the sake of my sanity, please only respond if you truly have experience in this state.  <br />

I have a 3.4 cumulative GPA and my pre-req GPA for their program is a 3.7. I graduate in May with a B.S in Health Sciences so I plan on applying next January. I have good grades and I am really determined to become a nurse. The only thing that is discouraging me from applying is an incident that I had about 4 years ago. When i was 19, i got a drinking and driving ticket, a misdemeanor. Do you think think this will ruin my chances of getting into any accelerated nursing program or do u think i have a good chance? thanks!</div>

This has been the worst weekend of my life.  I was driving my mother's car and was pulled over for a tail light - the officer asked if he could search the car and I said sure....well, 10 minutes later he shows up with a little white pill and ask me what it is.  :eek:  I told him &quot;I have no idea&quot; and he says it's OXYCODONE.  I've never illegally done a drug in my life so I told him it must be my mother's medication.  He didn't care and I went to jail.  From jail, I called my mother and she said &quot;that belongs to your aunt - she left it in the ashtray when I gave her a ride.&quot;  <br />

Anyway, I was arrested for &quot;simple possession of a schedule II controlled substance&quot; - a class 1 misdemeanor.  I pretty sure it'll be dismissed seeing as it was aunt's medication, BUT the arrest will always be on my record.  :sniff::sniff::sniff:<br />
<br />
I looked at the North Carolina BON website and it says &quot;In the application, <b>the question is asked whether or not the applicant has ever been convicted of a misdemeanor/felony/DUI</b>. If the response is yes, a certified copy of the criminal record must be submitted.&quot; <br />
<br />
So to my understanding (and hopes) when I apply for a nursing license, I can answer &quot;no&quot; to that question if I've only been arrested, but not convicted of anything....right?  <br />
<br />
This is my first run in with the law since I was a stupid 18 year old (7.5 yrs ago) and arrested for speed competition (racing).  The case was dismissed.    <br />
<br />
I have my bachelors degree in human services with a 3.9 gpa and a 4.0 gpa in all the nursing pre-reqs.  I've worked hard and thought I was doing everything right.....I would hate for my great aunt's pain pill to destroy everything I've worked for.<br />
<br />
I know you folks can't give me a definitive answer, but any comments would be appreciated.  I would hate to go through nursing school and end up not getting licensed or being able to get a job.  :crying2:</div>

			<content:encoded><![CDATA[<div>I had a friend take advantage of me.  I was charged with two felonies (theft and possession of criminal tools).  Upon investigation, they found that I was a victim.  The charges are going to be dropped, but it is a long waiting process.  I need to apply to nursing school before all this is taken care of and currently, the charges are still pending. <br />
<br />
I can explain that this is going to be dropping... I just have to wait for our insanely slow legal system and also explain that charges are filed before anyone bothers to investigate around here.<br />
<br />
Do you think nursing schools will believe me or will they reject me because of the pending charge? I looked into it and I am still eligible to take the NCLEX and practice as a RN even if I were convicted... you need two theft convictions and even then you are only banned from working with older adults.<br />
<br />
Should I apply, or wait yet another year?</div>

I met with friends for wine, got pulled over, and got an OWI (operating while intoxicated). I'm not looking or asking for any bashings; trust me, have had enough to last a lifetime and I know what I did was wrong. I am newly separated from my husband of 3 years, stressed out in a huge way, and just heartbroken; afraid that my dream of becoming a nurse is gone. I've met with and been very honest with my nursing director and instructors. I've raised my children, put them through college, and finally enjoying what I'm hoping will be a new career at the ripe old age of 48. I'm devastated and don't know what to do, other than drop my classes, save tuition $$ which I've taken out loans for, and let the situation ride itself out, then see what the future brings. I've worked so very hard, and my heart is in nursing. I hired an attorney who isn't sure how this will affect my licensing in April. Only 6 months to go! I take full responsibility for what I've done, but am desperate to talk to anyone who is in, or has been in this situation. Any help or advice is appreciated so very much. I need to decide this week whether to drop, or continue on. Thanks in advance for your response!!    :o</font></font></b></div>

			<content:encoded><![CDATA[<div>I have a couple questions, and would appropriate some insight. I recently got charged with an MIC (minor in consumption) because I am under 21. I have been talking to several attorneys and am trying to get this matter resolved as soon as possible. I was written a ticket, but not arrested (mugshot, police station, bail, etc, none of that). Attorneys are pursuing for the case to be thrown out due to an illegal stop (long story). So my question is,<b> since MIC is NOT a crime covered under my school's policy</b>, is it okay to not report it FOR NOW? Instead of listing all the charges, I listed the two that is remotely close to what I was charged with. <br />
For the record, I did clear my background check on admission. I will be discussing these matters with my attorney but I'd like some input from this community in the meanwhile.<br />

<br />
Definition of clean background check: No record of conviction of any of the crimes identified in II.B. <br />
<br />
A. Once admitted into a program:<br />
1. Students are required to immediately <b>report</b> any offenses <b>covered in this policy</b> to the appropriate Department Chair. <br />
2. Departments may check arrest records of students without notification.    <br />
3. <b>Failure to notify the Department of an arrest is grounds for dismissal.</b><br />
<br />
B. Derogatory information of the following nature gathered as the result of a background investigation is the basis to no longer consider a candidate for the program, as clinical placement will not be possible.<br />
 <b>   -Any charge related to illegal drugs such as (but not limited to) possession of drugs or paraphernalia, or  trafficking.<br />
    -DUI within past 3 years or more than one DUI in past five years</b><br />
<br />
C. Students who have an arrest for <b>any crime listed in this policy</b> while in the program will be removed from clinical.</div>

I have 1 DUI felony in 2001, I was just told by PBCC that I cannot appeal and I cannot start the program. I called the Florida State Board of Nursing in Tallahassee and they just told me that the only way you cannot get a license in the state is fraud, drug posession and child molestation. However before you apply for your license you have to complete the nursing program. <br />

I am totally confused now, so the state and the school have seperate laws??? Do I need to call FAU?? Can anyone give me advice please. I have worked so hard for this, I haven't even had a speeding ticket since 2001.:sniff:</div>

I got arrested when I was 17 for a misdemeanor charge of shoplifting (I know, very stupid), anyway, I just had to pay a fine. I live in Georgia and you are considered an adult at the age of 17 in GA, so this is still on my record now. I am currently in school to become an LPN, but I hope to continue school after this to become an RN. I was wondering if this misdemeanor charge would fall under moral turptitude or something. I am worried that after all of this hard work, I will not be able to obtain my license. Can anyone tell me anything that you know about it??? Thank you all in advance!!</div>

Unsubstantiated means that they could not find me guilty of child abuse only because they lacked sufficient enough evidence to do so. I was NOT convicted or found guilty of child abuse. I never appealed it, but now I think I should. Does anybody know if nursing homes check child abuse registries?</div>
