Anything I could get in trouble with on this?


I am interested in starting a consulting service for people that want to achieve wellness from the inside out. I would so this by integrating my healthcare knowledge about disease processes, healthy living, supplements, custom designing exercise plans, and nutrition guidelines. It would be personal consultation. My question is, is there anything in the nurse practice act of TX that forbids the use of my R.N. title in an advertisement? I would not be claiming to treat any disease. In fact my focus would be primarily on prevention (It's about time we started doing that in this country!) for those who want to feel and look their best, from the inside out. Any advice would be appreciated.

Personally I would contact the board of nursing for your state to make sure. Not that the opinion of other nurses is not helpful but froma legal stand point , if something were to go wrong , it would help me sleep better if my advice were coming from the place that could take away my nursing license if I was not in my scope of practice.

I am also interested in a similar startup but in another state. Let me know how you make out and what the reccomendation was from you state board of nursing. I will contact mine as well but have a feeling they will put some kind of roadblocks up to it. Hope I'm wrong

i'm no lawyer and i know they forbid giving legal advice on allnurses but i honestly can't see you getting into trouble by advertising "RN". it's a fact - you are a registered nurse. you are just advertising to people that you are are an RN. i think it' d be a different story if you were actually holding clinic, seeing patients, etc. that's definitely way beyond the scope of what an RN is. but wellness? i doubt it. but again, i'm not a lawyer...

That's a very fine line and while nothing explicit may be laid out in the Nurse Practice Act, you might step on the toes of the medical board. There's actually an emerging medical specialty devoted to preventative medicine.

Would your recommendation of various supplements be considered prescribing?

That may be a question for the state medical, pharmacy and/or nursing boards.

I have a BS in Exercise Science and am an RN. I would imagine if you are treating someone with a current disease process, to legally cover yourself you should get their physician to release them with a medical release form. Otherwise it would be just like you were a personal trainer. I would recommend steering clear of "prescribing" any types of supplements or a nutritional plan. My schooling for exercise science was very specific about not prescribing a diet plan due to legalities since we were not considered qualified - those nutritionist take a national/state exam just like nurses do. As far as supplements there are several people who have been sued due to prescribing supplements which when taken resulted in death/injury.
