:coollook: Hello Fellow nurses!!! Does anyone know about the possibility of the California legislation changing the length of x our nursing licence will show our DUI after completing probation? My probation manager told me yesterday that there is a proposal in the legislation now that is requesting our BRN record be cleared after completing probation. Or does anyone know where I can look for what is specifically bring presented to the ?? senate, govenor? presented to where ever it's presented to????

What about the criminal record of the DUI, that will not go away and will come up with background checks.

Too bad the OP isn't in WI then---first offense DUI is NOT a criminal offense. How crazy is that?

Exactly. I do have one DUI. Not proud of it at all :crying2: It's not a criminal offence. So I'm wanting to know what is being proposed to change what is shown when the public looks at my RN status.:confused::confused:

I have one DUI too with excellent work reviews. I have been writting senator Barbara Boxer about the excessive punishment for such offenses to nurses that are safe practioners. I suggest going to her website and doing the same. She has been responding very postively. We have no advocate and we need one.

Thanks for the info about B Boxer, I will take you up on shooting her an e-mail. but..... HELP. I'm new at this calling in with First Lab every day and I really want to follow the BRNs rules while I'm on probation. I forgot to call in, I actually check in on my computer, on a day I was to test. FUDGE!!! I've been on probation for one month now, short of a few days. This will be the second x I've missed check in. The first x was the second week and now this x was just a few days ago. I'm going to set safe guards to avoid missing. But what is going to happen to me????:mad::mad::mad:

thanks, God Bless

my husband says, "getting drug tested for a DUI is like getting your hair cut when you need your nails done"

What you need to do first is call first lab and schedule a immediate retest. Then call your probation monitor and explain what happened and u sched a retest. Unfortunately we are at the mercy of the board w there over zealous punishment , because they have the power to dangle our nursing licenses over are head like a carrot. Thats why we need some sort of movement or representation. Lawyers do not work fighting against the board. I spent thousands of dollars and recieved the same punishment. As far as missing your call ins it is easy to do. I got into a routine. Before I get out of bed in the morning I get on my phone and check in. The best way to check in is by calling in. I checked in by there website once and they said I didnt. I didnt miss a test but I had no proof I checked in, but if you call in and they say you didnt you always have a phone record as proof. I would definately call your monitor about this. They can and often do extend your probabtion by a year. So rediculous! Write Barbara Boxer and lets stop this craziness. I am declaring war against this craziness......

thanks dinguino. Today is Sat and FirstLab is closed. Do you think it wise to just take a drug test slip to the testing office and give my sample? I do have a concern tho, that is the missed test was Monday the 26th of Sept. I didn't know of this until I checked in this am and took a look at the "forms/reports" tab. I truelly don't remember if I checked in or not, but I take responsibility for this STUPID mistake, fudge, fudge, fudge!!!!!! I suppose if I have to tag another year onto my probation, then so be it. Let me tell you this though, the other RN's I go to at my peer group have not had another year added on to their punisment. I'm new to this so I havn't asked them what did happen to them. What I have been warned about is not to forget. On the other subject. My probation monitor told me that there is already a proposal in leglislation to change the BRNs guidelines, apparently it was heard very recently....do you know where to look for any specifics?

Gracious

So I would just call first lab on Monday and your monitor. Your first miss I have heard they don't do much about but you have been on probation for a month correct? You have missed twice and one being a test. Just call your monitor and realize you are most likely on the razors edge of a extension. Get into a routine of not getting out of bed until you have called in. I am in contact currently with lawyers. Legislation I am going after first are incidents that happened outside of work such as first time DUI RNs with good work reviews. The DUI will only stay on your record for 10 yrs just like your DL. If a addictionologist states you do not have a problem with addiction then no random testing. If your work states you are not a danger to patients then no restrictions at work for a non work related incident. If all of us nurses come together we will be a very powerful voice against the board. Alone we are nothing. Just a number. Things will change. I am going to see to that. I will keep every one updated.

What can I do to help?

:yeah::yeah::yeah::yeah: At first I was angry about the hoops I have to go thru to keep my licence and as time went by I gave in. BUT you're right. If I wasn't and alcoholic I should have the right to drink to my content while on my own time, as long as I follow the laws. Why in the heck do I have to test for drugs if I was caught drinking alcohol? Why does my jop have to be approved by the BRN along with someone supervising me while I work. I have one DUI on my own time ect. Again how can I help, let me know. Now I'm ******, and not in the Canadian way :smokin::smokin::smokin:
