Something going on???


Wondering if something legal was going on in California.

MY Agency has consistently denied my claim that I should be getting paid 8 HRS standard time and 4 hrs overtime, as is stipulated in Californian Labour Law.

This has rolled on for the last 6mths with them denying everthing.

You can imagine my suprise when they contacted me and told me they were going to start paying me the appropriate overtime rate and back pay as well.

As long as signed a disclaimer absolving them of any further claims know/unknown.

Call me an old cynic but I beware greeks bearing gifts.

Anyone got any idea what is going on?

I smell a class action somewhere

Your nose may be correct.
Either that or the labor Board has been sniffing around.

You can get up to 3 times your back pay, but the catch is you'll probably have to hire an attorney to do it. You can file your own complaint with the U.S. Department of Labor, but by the time they get around to investigating, the statute of limitations will be up. Depending on how much back pay they owed you, a labor attorney might be worth the expense. And by all means, sign nothing absolving them of further responsibility! They're pretty much telling you that they'll only follow the law if you sign this letter, which is in and of itself likely to be illegal!
