So, what happens to my case? my PD is Dec 2005 and i'm just waiting for my interview? Does this mean my application will lie dormant at P3 level and I will not be afforded a consular interview within the next few months?
Are you a Schedule A worker and through consular processing? If you are, then if the Visa Bulletin move forward to Dec 2005 then they will start working on your papers.
Hang in there.

yes, i am a schedule A worker and through consular processing. i don't know if they will still move forward to Dec 2005 since almost all EX visas are used up.
Just take it on the positive side, you are two months behind after the cut off date. Hopefully your papers will move before anything is done on this retrogression. Let us just hope that the cut off dates these following months will move forward instead of going backwards.

Not ture, quota could be used in the middle of October. On that day quota was used, application received will be allocated by lottery.
DOS issues monthly visa bulletins based on the number of estimated visas available for that month......actually DOS estimated that for the month of november, there would still be around 1,000 sched. A visas left but they estimated that more than 1,000 visas would be used up based on visa history issuance hence october was the last month of "current" status for sched. A.....
you have always amused me rhp123, what are you talking about lottery allocation????? :lol_hitti diversity visa lottery is not connected to EB based visas.....

Does it means that if one applies for I-140, I-485 and EAD within October, he can still receive an EAD while I-485 is pending?
yup i clarified that several times with my lawyer when i applied for AOS a few months back

thanks for your reasurance. If as what you said, is there a queue for cases filed before Oct.1, 2005? I am not quite clear about the priority date. suppose there are 1000 numbers left, how do then allot the number?

They will allot it to cases( submitted DS-230 forms) already at NVC but they will based it on a first come and first serve basis, that means the PD.
hi happylearning......
Department of State (DOS) is estimating that there would be around 1,000 visas left by november BUT because sched A will retrogress by November 2006, it only indicates that DOS is not gonna utilize this estimated 1,000 left over visas anymore.....
there is a FIFO queue but some people who filed later but got greencards earlier only means that their security check (name check) got cleared earlier compared to those who filed I140 earlier......meaning some who filed in 2005 got approved 2006 but some who filed way back in 2002 only got approved recently because they got stuck in name check
:yeahthat:

thanks a lot, joinRNMD!
I am still not quite clear about the 50,000 and PD date. do they still use the remaining 1000 in Nov. until it finishes and Schedule A will disappear or there are some other souce of visa numbers? will the PD date remain slow moving as other visa categories late on?
my PD is Sep. 2005. case transfered to embassy, now waiting for P4. will I be allotted visa if I am scheduled in Nov?
your idea is very important to me!

nope....as long as you filed 140 and 485 BEFORE november 2006, and USCIS receives your application before november 1, 2006 then you are SAFEremember that Schedule A visa is CURRENT for the month of OCTOBER 2006* by the way, this only applies to those who applies for AOS here in the US and NOT consular processing

Yes, this is correct. The current bulletin is for the month of Nov. and the month of Oct. is still current.
