Just noted that you are in the US. Did you go to school here and are on the EAD? I know quite a few that had their I-140 just submitted before the end of October and they have their approval already. Suggest that you have a little talk with your attorney. Especially if you are in the US already.

And did you hire this attorney, or your empoyer?
    Hello Suzanne 4,
Are you saying that if you went to school here, you can get approval faster? Just a question. I am on OPT now and will be filing my 1-140 this July to early August. Another question is after they approve your 1-140, will they also give you authorization to work at that time too.

    Hi Lawrence!

My I-140 was approved last May 2006. Will my paper be affected by the retrogression of processing dates in Nebraska service center?

    hi lawrence!

my i-140 was approved last may 2006. will my paper be affected by the retrogression of processing dates in nebraska service center?
we are not even sure yet if it does. the report was just recently posted and the processing dates being posted there ever since aren't really accurate in the 1st place for reasons i just mentioned in a recent post. it has never reflected accurately actual processing times as far as i-140s are concerned. that was the reason for the notice that you can read from that recent report. this was also the reason why we started our own nebraska and texas service center tracker for i-140's . nurses keeps reporting i-140s' being approved even though the dates posted in their reports has dates that seems to be stuck for a long time.

have you recently checked your case status on-line by providing your case number ?? there was a member here that has a pd date of july, 2006 and her file was seen by the nebraska service center. she was a given a rfe but nonetheless her file was seen and reviewed. if her file was complete, it would have been approved or if her agency sent the additional documents it would have been approved as well. fact is, her case that was filed last july, 2006 ( click this link) was seen and reviewed. you have a much earlier date so yours should have been reviewed as well. please check your case status on-line by entering your case number on the lower right side of the page and please update us.

    good luck. :spin:

Hi,Suzanne and Lawrence! Thank you for your help.
    My question is:
I'm in US awaiting for GC .I-140 was approved in may,2007. I went to school here, and working on EAD
I sent AOS in July ,2006. I'm checking uscis site every day,but there are no changes since I sent it:

Current Status: Case received and pending.

"On July 25, 2006, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when yours will be done. This case is at our NEBRASKA SERVICE CENTER location.... "
Do you think I have any chance to get GC soon?
    Thank you again

It was approved then, since last year. I got mixed-up a bit. You do not even have to look at the Service Centers. Your case was out of there since last year. It's suppose to be in the National Visa Center (NVC) since last year. Once approved, your case is transferred to NVC in just a few weeks time. Are you done w/ the visa fee bill and the DS-230 forms??

    Thanks for replying.

My agency told me that they were just waiting for retrogression to be lifted in order for them to pay the visa fee bill. Last week, due to the additional 130,000 visas, they told me that they will now be able to pay the bill and update my case at NVC.

Again, thank you, Lawrence, for all the info!

I can't understand why they are waiting to pay the visa fee bill? As NVC request the bill and once paid request DS230. NVC will not take any money off anyone until the fee has been generated

I agree w/ Anna. It was approved on May, 2006. Retrogression only happened in Nov. 2006. That's about 6 mos. They could have at least paid the visa fee bill. With 6 mos., your case should have been already in the US Embassy before retrogression hit in Nov, 2006 and just waiting for the interview before retrogression happened.

Sure, maybe you will be like the majority whose files were stucked in the US Embassy in Manila because of retrogression but nonetheless stucked in the latter stages rather than in the middle.

But this is the same story we keep hearing from agencies. Always blaming it on the US immigration system.

Lawrence, Anna, Thanks for the replies!

I already asked the agency the same question but they just told me that they are just waiting for the retrogression to be lifted. Sorry guys if my case is already getting off track with the topic.

    I140-Approval Aug. 6, 2007
Hope to get I485 approval in a few months. Congrats to those who got their GC from NSC. I am praying that the rest of us will get our GC's too before the end of the year.

    Hi, guys!
I've been reading this website for a quiet some time. Recently, there are no updates to Nebraska tread, I guess there are any news due to retrogression.

My PD Oct 26th 2006, I-140 approved in August 2007, than they requested evidence from my employer that about my position and salary (general info). Than ...

"On September 13, 2007, we received your response to our request for evidence. We will notify... You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing (already done) have not yet been completed, in which case you can use our processing dates to estimate when this case will be done.

There are couple days left and I have not heard anything, and my lawyer said I am looking for the next 4-5 years to get GC. Anybody in similar position? Is it 60 days to get answer or until Visa available? I thought if they opened my case I-485 , I will at least have some kind of update or answer in 60 days period.

Me and my husband are going home to visit our family and our child in December. We have travel documents. Guys, how safe is to travel with travel documents?

We have child at home and it has been 5 years separate, and according to my lawyer, we cannot file for her until our paperwork is done which another 5 years. Our daughter is has CP and a special need kid. I've heard about Humanitarian parole. Anybody has had experience with brinning your kids while on AOS?
Or may be I need to get Masters degree to move to EB-2 or go teach and get H1-B and get for my child H4 dependant? any answers will be greatly appreciated.
I do understand that nothing can be done about such a long wait, but it has been so hard without my child and any help would be blessed.

It is hard to predict how long it will take for GC but going the AOS route you will get EAD which is renewable and taking into account the amount of applicants you are probably looking at a few years unless they do something regarding nurses and immigration.

Even with travel documents the end decision is with the officer at POE

Unable to answer regarding EB2 if you get masters or Humanitarian parole but the questions may be why didn't you bring your child with you? Not that I am asking that question

Good luck, did try to return your email via the site but you have not set up to receive emails
