    Centers are not affected by the retrogression, they are continuing to process the petitions as they are received. Many times things are delayed when the file wasn't complete when it was submitted by the attorney and addiltional information was required. Since the I-140 approval is based on the job, and not on you; the additional information can be sent on without needing to contact you.

    I keep hearing that agencies are telling nurses that the centers are not doing things because of the retrogression and that is not so, especially if you are going thru Consular Processing. If anything, because of the AOS petitions not being accepted, or for the EAD, things should actually be running faster right now.

    Hello everyone. I just want to ask who has a latest approval at Nebraska visa center and what is your priority date. coz they are now processing July 17, 2006.Thanks.

    That date is only an estimate, and is not written in stone. We have seen that all along. Do not rely strictly in that date. There are quite a few here that got approvals in the past when their PD was much later than the date that was posted.

    Biggest issue is if the file was complete when it was sent and USCIS did not need to request more information. That is something that holds up many files and the attorney usually does not say anything about it since it was an error usually caused by them. They did not submit the required information in its entirety when the petition was submitted. Remember that the I-140 is based strictly on the job in most cases. Your personal information, as well as the family is on the DS-230.

    Thanks Suzanne. My I-140 was filed last Aug.1,2006 and no approval yet I asked my agency about it and they told me that its not unusual since visa centers are slow because of retrogression. Is that true? Also I'm worried since they filed my I-140 for almost 1 year because of the wage rate requirement needed. I got the job offer last Sept. 2005.

    What is going on the Nabraska, My petition was also filed Aug 1st and still no reply, has anyone got approved from Nabraska after this date?

    Hi! I sent my I140 to Nebraska in July,2006 and today I got notice that they want me to send request of additional evidence .I'm tired to wait.

    Nebraska averages 6-8 months base on reports here and additional time if a request for further evidence (RFE) was given.

    Also, there is no control on where the beneficiary's file ends up on w/c service center. All I-140's are in fact have to be filed on the Nebraska Service Center and they choose w/c ones are transferred to Texas and w/c ones stays. Beneficiary's lawyer has no say on this as well and they do not give the reason for the basis on w/c ones gets transfered to Texas and w/c ones stays.

    Shame on that agency and attorney is all that I can say. There is no reason in the world that it takes a year to get the wage rate agreement. None whatsoever. And it looks like the first petition got denied and then they resubmitted it. Next question is did they have your permission to do that? Did you sign the new forms or did they forge your signature?"

    And the centers are not slow because of the retrogression. All petitions go thru these centers, they are not only for nurses. And they have not slowed.

    Blame the agency and the attorney, not the US government for this.

    18 months? Get a new agency. They are doing something very wrong here. You should have been in the US already, not still waiting for approval of the I-140.

    thanks, but i just want to clarify that retrogression has no impact as far as processing for i-140 is concern. processing time depends on w/c service center your file is being processed. the impact of retrogression is in the national visa center and medicals & interview in the us embassy if via consular processing or filing of adj. of status (aos) and employment authorization document (ead) if in the u.s. already via a tourist visa.

    I just wanted to ask you : my attorney got letter form Nebraska center for additional information for I140 that was sent in July 2006.When I called my attorney and asked what kind of information it is,thay didn't answer me,they just said: don't worry ,we're working on it. I tried few times,but didn't get the answer. It's my right to know ,isn't it? Or may be i'm wrong,and they know what they-re doing and i'm too nosy.
