The latest processing update for CALIFORNIA SERVICE CENTER under I-485 is October 18, 2007.

Does that mean that they have already processed the JULY/AUGUST 2007 applications? So greencards have been issued?

No. GCs can only be issued if there are visas available and the Dept. of State thru their monthly visa bulletin is the one that tells if there are visas available or not.

That just means that the I-485 cases under that specific service center has more or less adjudicated I-485s on those dates. An adjudicated case doesn't mean automatic GC. It just means they have made a decision already on the I-485 petition. It could be approved, denied, or awaiting RFE. Even if it's approved, it will sit there until visas are available and GC can only be distributed once visas are available.

You need to know what was the decision on your case first. An adjudicated I-485 does not mean an automatic approval. Are you even sure that your case is under CA SC ?? They do not go on geographic jurisdiction anymore. The diff. service centers pretty much transfer cases to one another to share the work-load.

I also have some doubts of the accuracy of that report from USCIS. Last day of filing of I-485 was Aug 17, 2007. They have not been accepting I-485 since then, so how could CA SC state an Oct 2007 date for I-485 for employment-based. This is more likely an error, w/c commonly happens by the way. They always adjust dates there a couple of days after they cite an error.

USCIS can only go as far as Aug. 17, 2007 since that was the last day of filing the I-485.

CA SC also do not commonly adjudicate I-485s, usually it is TSC and NSC and in the relatively recent times VT as well. This is the first time I've seen CA SC having an I-485 for a long time, add in the Oct 2007 date w/c is impossible since last day of filig of I-485 was Aug 17, 2007 points that this is most likely an error.

To amend the Immigration and Nationality Act to eliminate the per country level for employment-based immigrants and to end the spill-over of unused immigrant visa numbers between employment-based and family-sponsored categories.

In addition to this, another possibility is that since it does not differentiate between the diff. EB categories that they are just reflecting I-485s of those who are in EB1 and EB2 (of most countries) w/c are always current.

I personally do not like this one. This is good down the road when all the backlogs has been eliminated so that everyone will be on equal footing.

If they do this now when there is considerable backlog in both EB and FB categories, 1-2 countries will be hogging all the visas since there are more demand coming from them. To be exact, applicants from India and China will be hogging almost all the EB categories while Philippines and Mexico may hog all the visas from the FB categories.

May I know what priority dates are now being scheduled for embassy interview?--or just give me idea about this.I heard from the other blog that someone has a PD of October 2005 and until now he's still waiting for his interview date.How true is this?.As far as I could remember, retrogression started on October 2006..How could a PD of October 2005 havent got any interview yet??..or it depends on the situation of his papers?..By the way, MY PD is May 2007, I know its not yet current but just asking about the case I mentioned a while ago.

He needs to check with his lawyer that all the paperwrk has been submitted. Usually with a PD of 2005 there has to have been some issue with paperwork. The visa bulletin gives a good indication on what dates are being processed
