Please pay attention to your contract before signing it. There is no such thing as a free green card. The money for it will be coming from your pocket, not the agencies. In most cases, there is about $5 per hour taken from you to cover the expenses. This works out to about $20,000 over two years. Expenses are about $4,000. You do the math.

The better way to do things, if you can afford it, is for you to pay the fees, and then you are in control, and can pick your attorney, etc. The facilities are normally paying a relocation fee that will cover your expenses.

Also, pay attention to what the cancellation fee is. If for some reason that you would need to leave your contract early, or the facility cancels you, you will be responsible for paying that fee. The document that you sign is a legally binding contract. And some contracts can be as high as $15,000 to $20,000.

If your recruiter makes a promise, but it is not written into your contract, then it doesn't exist. It must be in writing and signed off by the management of the agency. And oral promise will not mean anything, especially if your recruiter is no longer working for that agency later on.

I am desperately in need of help and advice. I signed a contract with OGP almost 2 years ago. They sponsered me for NCLEX last year and i passed in the month of august 2005. I have also done my cgfns and ielts independently. My file right now is in NVC and will probably reach the embassy in the next 1-2 weeks. My problem is that my agent is now demanding that i sign an amendment to the original contract in order to proceed. They havent placed me in any hospital yet. According to the amendment, my cancellation fees is going to exceed 45000$ and they also want the spouse to sign as the guarantatoer for that money. It also states that in case of breech i will even pay form their attorney and other legal expenses. The cancellation fee in the initial contract was $20000 after reaching america and $8000 for breech before reaching there. I feel totally trapped. Is there anyone who can advice me???

This has been brought up in the UK forum, a few UK nurses are having this problem. I would say that they are in breech as expecting to change contract

Cheeky thing to do - waiting until your file is in, then asking you to sign a new contract to proceed. You should contact a lawyer to look through your contract and see what you have already agreed. I would not trust anything their lawyers are telling you.

Definitely speak with an attorney as soon as possible. It is atually illegal for them to amend the contract right before your interview date...........you were approved based on the contract that was submitted.

There is no way that I would tell anyone to sign a contract like that........they need to live up to what they offered initially to you, for them to want to change it, means that they are not living up to their part of the contract and it is a two way situation.

I am also scared because they are holding my RN and Visascreening certificate. If at all they refuse to give it back to me, can i get another one with just the RN number ?

If they paid for them, then they belong to them, until you pay them for them. This is why I always recommend that the nurse pay for everything, then the licenses, and documents are theirs, not the agencies.

You really need to speak to an attorney right away, they are in breach of their contract that you both signed. And not their attorney.

I don't think breaking your contract will help, as you need to have the NCLEX first and an immigrant interview scheduled in order to not be affected by the retrogression. Perhaps ask this question in the "Questions for Suzanne4" thread as she can give you expert advice.

Sounds to me like you are not very far along in the process.

Have you tried contacting them regarding expecting you to sign a new contract despite you signing up with them 10 months ago? Personally I would discuss with a lawyer as I don't think it is fair of them to change things and expect you to sign, it should start from the new ones joining not the ones already committed
